Another ebay question/help

Hi Guys

I am sorry to ask this but I need some help!!!!

Over the last three weeks I have brought three items. Two I haven't recieved & I have sent messages to the buyers but I have had no responses so do open items not recieved?? Sorry this hasn't happened before....
The 3rd item I have recieved and it is a fake, I have sent photos of the said item to the company & they have said that it is a fake, so how do you think it is best to proceed.????
I was led to believe on the listing that this was a geniune item...
I really don't want the item, & I really can't afford to lose that amount of money?

    Firstly, if you have waited 7-10 days for an item that has not arrived and seller is not responding then yes open a dispute on paypal. If you still don't hear anything in say 48 hours escalate the dispute to a full chargeback for item not receievd.

    As there are two items you might also just want to double check with your local delivery office as they do sometimes forget to card you.

    As for the fake, if you can get the shop or manufacturer to state it is a fake on headed paper then paypal will get the seller to refund you and ask you to destroy the item. If you can't get that proof then the only way, and this is where it gets silly, is to go via a full SNAD claim. Frivolous Fay is our guru on fakes, but i haven't seen her log in for a while.

    Thanks for that. I have checked my local sorting office this morning, they have nothing ! I have sent messages via ebay, do I have to open the dispute on paypal or ebay? and if on paypal how do I do that (sorry in advance for sounding silly?!?!)
    Also can you tell me what a SNAD claim is?? Would you advise me not to contact the seller & offer to pay the postage to return the item for a full refund, I would much rather lose the postage then the item cost... if that makes sense?

    Personally I always prefer a paypal claim as it is a simpler process. Log safely into paypal, find the transaction and there should be a 'report a problem' or suchlike thing there (I haven't done one for ages so I can't remember what it says). OPen a basic dispute and just send a polite message to seller letng them know that the item has not been received. After a couple of days escalate that to a full chargeback if you don't have a response. Whatever you do don't close any dispute whatever seller says.

    Sorry, that's about as clear as mud isn't it? I'm sure someone will interpet my post for you...

    As for the fake item, I might just be tempted to do an ebay claim on that one..but I'm just not sure what is best as again I haven't done one.

    thanks for that.. I have never done a paypal claim. But it is clear.

    The item that I purchased that I believe is a fake I have spoken to the customer services and they will authenticicate (sp?) I will have to send it to there head office, if the item is a real item then they will send the item back with corresponding paperwork, however if the item is fake they will destroy the item & send me the paperwork to prove this.

    Do you think I should advise the seller what I am doing ????

    I would email the seller and explain you think it may not be authentic and ask if they have anything that can put your mind at rest. It keeps things nice and polite. I wouldn't tell them you have sent it off for authenticating.

    Take your next step depending on the email response you get.

I hate being horrible but found it worked for me. Hope it all gets sorted

    IMHO this would be a last resort and only once I had the evidence to proceed, if they call your bluff then you may find you cannot obtain the relevant proof to win your case. There is no reason to suggest that the OP's seller has tried to deceive, if you treat people with the respect you would like to be treated, it can allow matters to progress smoothly. The last resort is always your trump card, don't play it too early.

    Tahnk you all for your help, I have contacted the seller & thanked her for her great comms & fast dispatch & delivery of the item, but I have expreesed concern in the the item & asked if I can send the item back via special delievry at my expense for a full refund! I am awaiting a response, I will feed back as soon as I get anything !!

    Ok guys update!
    the item where I believed not to be an authetic item has been sent back & refund has been given. The other two items where I haven't recieved them I have opened a claim, the one person hasn't answered the other person as said she posted it 14 days after I purchased it & once it is posted it is up to me now, not her!!! So what do I do now re the paypal claim???
