    Sadly, the delay with the deposit is always going to be tricky (even if you didn't work). It might be worth arranging the check-out inspection a few days early to see if the deposit delay can be kept to a minimum. If all is well, get the new LL to speak to the curent LL and he may decide to wait a few days for a deposit from a good tenant.

    Being in full time employment doesn't make it any easier to rent or to find accommodation. The rent we pay is more or less half of what I earn, hubby hasn't worked for 3 years through ill health.
    Housing Benefit tenants are readily accepted by a lot of agents/LL.
    Our current property is through an agent and our new one is also. We have been told the check out will take place up to 5 days after we vacate, this is 5 days after we have to pay the 6 weeks in advance deposit.
    The current deposit is paid back to us up to 10 days after check out, assuming everything is OK.
    There is no easy solution to this, it seems alot of people are looking at new ways to get more money (aren't we all!) we've had to pay £300 to secure property + £200 for agreement to have 2 very old cats at our new property.
    No bank loans, credit cards or family to fall back on, it all makes it extremely difficult and stressful.

    I suggest you explain this to the current LL and stress that the delay in the deposit may lead you to losing the new property. Should that happen, of course, you would have no option but to remain past the expiry of the S21 notice and may even be forced to make him go through the lengthy process of getting a court order and bailiffs warrent. The whole ethos of the tenancy deposit scheme was to avoid this situation. To make you wait 5 days for even a check out inspection is, frankly, a disgrace and you shouldn't tollerate it. Once the checkout has been done, you can get written confirmation that they will not be challenging the return of the deposit. That MAY satisfy the new LL. If not, it MAY help you get an extended overdraft or short term loan to cover it. Either way, not working would make no difference to the above.

    thanks for your advice Wee Willy but theres no way at all that our current LL is going to do anything that the agents don't already have a policy on.
    LL is an extremely rich guy, seems couldnt give a toss about his tenants or maintaining his property although he does do the repairs when asked.
    Couldnt even approach him about something like this, it would be beneath him, he doesn't reply to a lot of things we've asked.
    Waiting the 5 days is standard practice with the agents apparently and if we don't have the full amount of 2.5 months for the whole deposit on check in at the new house we couldn't do it, we've asked.
    If I didn't work I could apply for an emergency grant to solve this issue, yes it would have to be paid back but at least there would be some monetary support available.
    I hear of this kind of thing all the time in Housing, I work for Local Govt but not in Housing.
    Doesn't seem like an easier solution, everyone seems to abide by the rules in case they get stung.
  • Five days after you move out is pushing things a bit.
    What if you have other things to do (setting up your new home comes to mind) when they want to do an inspection of a home you have not lived in for at least five days. My upcoming inspection is actually a day early (the actual move out date is a sat) but no idea how quickly they will return any deposit left over (after they have deducted for a white carpet that clashed with a three year old over the year).
