Moorcroft are lying thread- (post #35, they've conceeded haha... but I'm not done!)

    I agree. At most orange can add cancellation charges, which really is just the amount still owed.

    If you settle with orange directly, there is no amount moorcroft can collect nor attempt to charge you for. As you never agreed to pay for their services.

    Exactly, at this point Orange would still be the owner of the debt so settle direct if you can. They use these companies to get their money in a much more 'direct' way that they could do themselves.

    Moorcroft have no actual power to add additional charges on, they'll just see what they can get away with.

    Got the breakdown of the account and a statement of every call, text message and minute particle of data I have used in any way shape or form since November last year. Have a guess how much it is then?

    Yup. £399.65.

    So the next thing is the OFT complaint then.

    Good thinking, make sure you settle the outstanding amount you agree is your responsibility with Orange.

    Glad you have some proofs of the amount owing, but if it were me I would just pay Orange direct. If you have online banking, their payment details are on the back of any bill.

    You could refer Moorcroft to the FOS for attempting to try it on with you. If the FOS investigate it, then that's minus £500 for Moorcroft.

    Update:

    Orange got back to me, with a written copy of the statement of account. I now have it in hard copy- Orange don't know anything about the £140. Moorcroft have written again, once more insisting the £140 comes from Orange and is "contract charges". Although clearly it isn't, because 2 phone calls and two letters from Orange say different.


    So the complaint to the FOS is all written up, ready to go in tomorrows post, with all supporting documents.


    It sets out my complaint as:

    • Moorcroft have illegally increased a debt, without my consent and in the full knowledge that they do not have my consent.
    • Moorcroft are seeking to deceive about the origin and nature of the disputed £140 charge, claiming repeatedly it originates with Orange when in fact it does not, Moorcroft have invented it.
    • Furthermore, as £140 represents 35% of £399.65 this charge is disproportionate to the debt amount.

    It sets out the resolutions I would like to see as:

    • The £140 to be formally removed from the account.
    • Moorcroft to acknowledge their illegal conduct and apologise in writing to me and to their client Orange Personal Communications.
    • The account to be returned to Orange.
    • Finally, I would like to see Moorcroft make resolution to the Financial Ombudsman Service not to behave in this manner again.

    An FOS complaint is definitely advisable, but also don't forget a complaint to the OFT Consumer Credit Licence Fitness Section, and one to Consumer Direct wouldn't hurt either.
