Hi all,
After some advice as I'm not sure on my rights at the moment after being called by Comet on Friday.
Basically I was supplied with a Monster Green Power surge protector from Lincoln Comet. After 4 and a bit months and its first real test of stopping a surge it failed. Comet have said they are responsible for providing the Monster Green surge protector.
However, they have said that anything relating to consequential loss due to this items failure should be done with the manufacturer direct.
Its been over 4 weeks now since the incident and have had to claim on my house insurance. I sent them a letter dated 30 Jun 10 giving them 14 days for resolution before legal proceedings begin but I've just been refered to the manufacturer again.
I have put this on the digital tv forum, but I need advice on if I'm following the correct path and that I should be pursuing Comet.

Thanks, they keep telling me i should refer to the manufacturers guarantee. Thing is this is an American company with an office in Ireland, so god knows how long the process is with going through them. Any proceedings you issue should be against Comet.
What actually are the extra losses you have suffered?0 -

So far my Insurance Company have replaced the tv, dvd player and external Hard Drive. Totalling £826. This cost me £50 excess and premium has been raised by £26 per year also I still have this surge protector (£99) that nothing has happened with. Then there has been the two record delivery letters to Comet totalling £2.30 (yeah I know) but hey its me having to pay out to get this sorted.IVA Completed - 2010"Wine for my men, we ride at dawn"960 -
I am not sure but I think that the cover these products give is a form of insurance taken by the manufacturer. If this is the case you should be able to make a claim against their cover instead of your own.0

I agree. I have a power surge 4 way extension thing. I got this off British Gas. The unit is made by/supplied by Pact International. The surge guarentee is from Pact International. In my opinion, I could not claim BG for anything. The surge happened. Sue the electricity distributor or the manufacturor of the surge unit. Comet supplied it but in this instance, but Comet is blameless. Please let us know how you get on.0

Surely if you have claimed on your home insurance you are not out of pocket at present?
If that is so then I would have thought that it would be upto your insurer whether they wish to pursue Comet for their money back or not0 -

We have had nothing but trouble with Lincoln Comet they misold us a time card dozy !!!!!!! is it the tritton road one?0
