Totally agree with Easy's post. Let your insurance handle it and they will persue the nursery & the strimmer operator. You & your insurance company don't have to prove anyone was negligent just that the sunroof was damaged by a stone from the strimmer which means they are responsible.
It shouldn't affect your no claims if it is settled and your insurance get the money from the third party who caused the problem.0 -
I am sure you would win if you take case to small claims court, but is it worth the hassle? I would take photos, statements from witnesses and discuss with my insurance.
I do not agree. It may not affect NCD, but many insurers load for no fault claims. I don't wish to claim for loss of days earnings, you seem to be seeing things that I haven't stated, I just am p'd about all the inconvieniance of today.
I appreciate you haven't stated that (though you did tell us you were losing a days work)
The point I was making was the costs to you are escalating out of proportion to the £75 or so you would have to fork out for your excess, letting you get the job done asap, and leave it to your insurer to sort out the issue of liability/council etc.
So far your costs incurred surely outweigh getting the woman to pay you the £75 you want off her?0 -

Not true - the fact that it happened does not mean that a claim is bound to suceeed.
I'm sorry but for a claim to succeed against the nursery then negligence will have to be proven.0 -
Nonsense, a small bit of gravel propelled up in air, maybe a few feet, and back down shouldn't have enough force to smash a toughened, glass sunroof.Police seemed to think gravel being sent up in the air was responsible. isn't this how car thieves break windows in cars, just a few bits of small gravel?
BTW, do you have legal cover with your insurance, or any other insurance policies you have?0 -
Update.
Autoglass cancelled as it would be too expensive on windscreen cover.
Tesco said to get in touch with them again, get someone round to assess.
Will be £75 excess if it is just glass.
£850 and lose 2 years no claims if it is not just glass.
Got back in touch with Auto glass, they just phoned me back, 6 week wait for the part and costs £700 just for the glass, now waiting for any ideas from Tesco.
Had it been the sliding sunroof in the middle (have 2) it would be £2,100
Still a possibiity that it may be written off just for a sunroof.
Awaiting Tesco now. And 6 weeks without the car!0 -
Where does the £850 come into play?? Surely your non galss xs is not that high. Can't you tell if it is just glass? What else is damaged? What car is this? It is like tales from the unexpected.
I have never heard of throwing gravel at a car to break the glass. Throw gravel at the girlfriends bedroom window when I was 14 and even that did not break.0 -
i had a panoramic roof on a Peugeot 407 SW replaced on glass cover. The cost exceeded the claim systems ceiling for glass cover so it was put through teh regular full blown accident claim system in order for it to pay out but i still only had to pay the glass excess of £70 to the fitter (autoglass) and my NCB was unaffected. The final claim total was in excess of £1800.
If you like that car and it does get written off you could always buy it back and get a sunroof from a scrapie and have someone fit it.The difference between genius and stupidity is that genius has its limits0 -
Apologies for not reading the whole thread but;
You don't have a cat in hells chance of proving what/who broke the glass
It is a glass claim, which I think is subject to exactly the same excess as a windscreen/window/roof window.
You could always try to blag the excess, £50/70 whatever from the owner of the place.
You have to ask yourself if it's worth the hassle, certainly not a court case.
