Three (3UK) change to unlimited data usage policy

Hi there

A month or so into a 2 year contract with 3, I hear that their unlimited data policy is now no longer unlimited, but has a 500Mb cap. I never expected it to be limitless, but a fair use policy and the term "unlimited" implies more than 500Mb, which is one of the smallest caps I have heard of.

It seems to me they have materially changed the terms of the contract. Is that right? Does this allow me to leave whenever I like?

You need to double check whether it applies to existing customers or is it just new customers.

Three sent me a text message a week ago saying "Important changes to the way we describe your package, see free link for more information: mobile1.three.co.uk/comms/da/a ".

This link initially took me to a page that described their new policy. The page has now been taken down!

Thanks -- I saw that there was some VF discussion but it's not clear to me what the conclusion is at to whether this allows breaking the contract. I guess the answer was "it depends" and "it's down to what you can argue"?

Orange have the same cap. Ludicrous really, in this day and age, when mobile internet is taking off big time with Android/iPhone devices, etc. In America they have already got 4G (upgrade on 3G, faster speeds, etc.) and HSDPA+ (faster version of the best (few and far between!) UK mobile internet speeds). Let me guess, the UK networks will keep putting off investment and impose more and more restrictions. 4G probably won't be here 'till 2012 at the earliest, even though 4G phones are coming out already. Hell, you either go with T-Mobile with an above-average 1Gb (3Gb on Android) cap, with throttled speeds if on the 1Gb policy, or you have the rest of the networks constantly changing T&C's and cutting costs by imposing tight caps.
No data access (outside of WiFi) on a Smartphone = not so smart a phone.
Time for a bit of OFCOM intervention, me thinks, it's "in the best interest of consumers" - as they all say to the Tories to keep their budgets intact. :P
Plus it's 2010 - surely we should have top network signal everywhere in the UK!

The cap always was 500mb in the small print, so nothing has changed really except the limit has been made clearer and the word unlimited removed, which was rediculous in the first place as it wasnt even close to unlimited.

its been while since I've checked their t&c but I believe they change the cap from 1GB to 500Mb back in April when they introduced their new 24mth plans, but I could be wrong. I've not had three mobile for 12mths now.

Arent the caps to ensure people arent beating the crap out of their connection? I.e using as a modem/p2p ect.

So if theres no fair usage policy anymore and a fixed cap, isnt this a change of terms within the contract. I mean theres a whole policy removed now even if its the same end result. I would like to know also if this is a loophole to get out of the contract, i feel mislead when i signed up for unlimited internet usuage to be sent a text telling me im near the 500mb limit.
