I think for the time being I'll wait for DM's reconsideration decision.
I have sent in extra info to them in the hope that my DLA is reinstated. Hoping for a miracle, arn't I :rotfl:! ! !
Just a quick update on my case.
After DLA reconsideration, taking just over 5 weeks, my award has been reinstated without me having to appeal. Mobility stayed at High Rate but Care reduced to Low Rate (from Middle Rate)
All was backdated to when my failed ESA Appeal Tribunals' decision effectively stopped DLA.
Just wanted to post this in the hope it gives others in a similar situation the push to take things a step further. If YOU believe you are entitled to receive help, please find whatever it takes to argue your case. I believe this is a very important way forward to improve the current system many of us are battling with !0 -
Congratulations Moneybag - glad it was reinstated for you - are you going to query the reduction in care component ?
They have had our GL24 since 1st July - so still early days yet - we have had a letter to acknowledge the 'GL24/appeal' , and they said that they would look at all the info again - funnily enough it didnt mention that we asked to go to appeal rather than reconsideration though ?
Still wondering whether to put a fresh claim in to run in tandem with the appeal ?

Thank you for your congrats and yes I am going to query the decision to reduce the Care component. My care needs are equal if not higher than before a recent operation on my spine.
I hadn't intended to ask for it to be highered as I was waiting for at least a 3 month recovery period to assess how I am. However I did point this out to DLA when writing to ask for a reconsideration of their decision to stop my award altogether.
As you can imagine I'm afraid of jeopardising what I now have by querying it again, therefore before I go ahead I am seeking CAB advice. I already have an appointment to discuss taking my ESA appeal a stage higher so I may as well go the whole way now !!! I would say I've nothing to lose, but that's not the case for most of us, is it.
I still stick with my thought that if I believe I am entitled to this then I should find the strength to fight for it (not always easy, especially when supposed to be recovering from an operation).
