Reapplying for DLA

If a claim is turned down..
can you reapply whilst an appeal is ongoing? (i thought i read somewhere that you can?)
or is there a time limit in place for reapplying - ie is it 3 months from original decision or from original date of claim? or maybe there isnt a time limit at all ?
Any thoughts would be appreciated thanks. x

Hi Sox,
Yea, you're right. You can go ahead and re-apply for DLA while your appeal is ongoing. Would do no harm to try and get as much medical information with regard to your Disability to send along with the re-application.
Also, please note, that DLA is not based on your Medical Condition or your Medication (eg: should you have a heart attack, they don't care.) It's how that condition specifically affects your care and mobility needs day to day. Eg, if you need help to dress, make meals, support when you're out and about etc.

I hope you don't mind me butting in on your thread, but it is relevent to the OP's question.
Does it also mean you can re-apply if your case is being reconsidered after being stopped (due to failed ESA Atos medical ! ).
I am 4 weeks into a possible 11+ weeks wait for their decision. ESA was stopped, then immediately reactivated at assessment rate due to my medical condition (so no break in money).
I ask because if I am unsuccessful after their reconsideration I will have wasted time that could have been spent doing another application.
Not sure if it's best to just sit it out and wait. Anyone have any thoughts on this ?0 -

Sorry, didn't make myself clear in my post. It is DLA I'm asking about re-applying for as it was stopped due to failed ESA medical.

I was told to go straight to appeal using form GL24 for my DLA, as the decision is automatically reconsidered before being sent to the Appeal Tribunal. I sent some extra evidence with the form and said I would be sending further evidence shortly.
This lead to my DLA being reinstated at reconsideration. Nothing to stop you putting a new claim in, but I would concentrate my efforts on the appeal. If you have new evidence to use in a new claim, you would be as well sending it in as part of your appeal.(Hope that makes sense lol!) Your benefit will get backdated to the original date of your intial claim if you appeal. A new application means a new start date (I think?)0 -
Thanks Millym - i get what you are saying with the dates etc and thats how i understand it too. I just wonder whether its worth sticking in a completely fresh application because there seems to be no continuity with the dm's decisions and awards. GL24 is in - havent heard back yet but expect the appeal process to be a long affair - just wondered whether to stick in a fresh claim as well - thanks for your help x0

I have sent in extra info to them in the hope that my DLA is reinstated. Hoping for a miracle, arn't I :rotfl:! ! !0 -
it says on my dla and incap paperwork that i must re-apply immediatly if there is any change in my circumstances which may affect my claim, so provided there is some change(minor or major) i would say you can re-apply under the dwp guidelines regardless of appeals0

hi sox, have you had a statement of reason yet? i think we are pretty much at the same stage of appeal as my son got turned down a few days before you. I haven't had mine yet0 -
Hi - his refusal letter went into each point enough for me to go straight back to them with the GL24 - sent that recorded post at the last week - let me know when you hear anything x x0
