I posted a few days ago with this story:
I won a dress last Sunday (two weeks ago now), and paid instantly through Paypal. I wanted it for a wedding yesterday(last Sunday), and yes I did make an assumption that it would be posted within a week.
It didn;t, so I ended up having to buy another one for £85 having already paid £65 for the one that hasn;t arrived.
I had emailed the seller and got no resonse, so pulled their number and it was a dead number.
I got an email three days ago (last saturday now) saying they'd been on holiday, and would get some sleep and email me the next day. They haven;t.
I emailed asking them to contact me 'to resolve' as promised (their phrase not mine)
She sent me the dress and I had to go and sign for it yesterday.
I emailed her saying I didn;t want the dress, and she has ignored that email.
I read on here about sellers having to post in seven days - what's the deal with that? Because of that's true - she didn;t, so I have agetout clause as I do not want two dresses the same.
THe thing that's annoying me is that when I neg her she's gonna neg me, which I feel is very unfair.
What's the 7 day rule and what should I do? I'm not keen on selling it myself as I don;t thinkI'll get my money back. The new dress from her has all tags attached - should I try taking it to Karen Millen saying it was a gift I don;t want??
I really don;t want this seller to get away with this as i have been very nice and polite but explained because she went on holiday leaving a listing un attended, I had to pay for two dresses. And she has just ignored it! :mad:

Sounds like you collected it?My TV is broken!

Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j0 -
I didn;t know what else to do - I posted on here for help but none was forthcoming, and I didn;t know if I;d be out of pocket if I just left it as she has my money, and could prove she posted it, and the PO would know it was at my local depot for me, so I fetched it yesterday.
What do I do now?:cool: DFW Nerd Club member 023...DFD 9.2.2007 :cool::heartpuls married 21 6 08 :A Angel babies' birth dates 3.10.08 * 4.3.11 * 11.11.11 * 17.3.12 * 2.7.12 :heart2: My live baby's birth date 22 7 09 :heart2: I'm due another baby at the end of July 2014! :j

If you try taking it back without proof of purchase, they will either assume you stole it, or at best give you a credit note.
Just because something is sold 'BNWT' on ebay doesn't mean that it is from a recent season either...
edit: Is the dress you brought from the shop the same as the one you brought off ebay?April Grocery Challenge £81/£1200 -
I bought both from eBay. New they are worth £150. I'm told they are current season but really that's a red herring. What rights do I have with eBay over this seller?:cool: DFW Nerd Club member 023...DFD 9.2.2007 :cool::heartpuls married 21 6 08 :A Angel babies' birth dates 3.10.08 * 4.3.11 * 11.11.11 * 17.3.12 * 2.7.12 :heart2: My live baby's birth date 22 7 09 :heart2: I'm due another baby at the end of July 2014! :j

Taking it back to the shop is worth a try, though it might not be recent enough for them to take it back. Even if it is, many shops have just finished their sales, and if you return an item without a receipt, you may be offered a credit note for the lowest price at which it's been sold, which could be a fraction of the original price.
Since you have received the item you paid for (albeit late), I don't fancy your chances of getting a refund from the eBay seller. Did their listing specify their usual handling time?0 -
No time specified, but I consider a fortnight to be way too late. What is this seven day rule please?:cool: DFW Nerd Club member 023...DFD 9.2.2007 :cool::heartpuls married 21 6 08 :A Angel babies' birth dates 3.10.08 * 4.3.11 * 11.11.11 * 17.3.12 * 2.7.12 :heart2: My live baby's birth date 22 7 09 :heart2: I'm due another baby at the end of July 2014! :j

The 7 day rule is what is generally accepted, it is not however written anywhere in the terms and conditions so you cannot refuse the item on the basis of the delay.
I can't think of any solution to this personally, have you tried searching through the (usually unhelpful) ebay help pages about items arriving too late or for deadlines etc?

I think eBay advise the seller to post the item within seven days because that is when you can open a dispute with PayPal. If I were you I would sell it myself.-->♥<-- Sugar Coated Owl -->♥<--

I've reported her for incorrect contact details and emailed her again asking her to get in touch by the end of tomorrow. If she doesn't I'm going to neg her.
I thought I'd be safe with a power seller but clearly not.:cool: DFW Nerd Club member 023...DFD 9.2.2007 :cool::heartpuls married 21 6 08 :A Angel babies' birth dates 3.10.08 * 4.3.11 * 11.11.11 * 17.3.12 * 2.7.12 :heart2: My live baby's birth date 22 7 09 :heart2: I'm due another baby at the end of July 2014! :j

def neg her let other people know what shes like,
perhapes u could ring and see if the shop would take the dress back before wasting ur time/effort/money going to a store - just to be told no
otherwise i would say just sell it yourself xmas is coming up and im sure there are a few people looking for dresses
sorry cant offer anything more helpful:rolleyes: Democracy is a process by which the people are free to choose the man who will get the blame.:j0
