having read your blog my concern here would be the fact that you have made a lot of repairs to the car. I'm not 100% on consumer law, but surely this deems you as accepting it?

? sorry i made no repairs to the car, i had to trim the shell as the tyres didnt turn without damaging it.

This was done after speaking with the company.

My complaint isnt about the things i had to do it is about the concerns i had and when would this stop as the quality was so poor.

The company added to my concerns when they didnt respond to my questions and i could see there support wasnt helpful at all.

I know i would of had a £400 rc car that broke everytime i used it correcty and i would of had no support from the supplier to remedy this.

I know it is classed as a hobby but surley there has to be some quality control, i had it less than a week.

Apologies if I have read your blog incorrectly, but you make numerous references to repairs and cutting to make parts fit.
The servo plug would not fit into the failsafe due to the tag, I adapted the failsafe rather than cutting the tag off the servo plug by cutting a slot in the socket for the tag to slide in to.
02/07/2009 I noticed the occasional spray of fuel when priming the carb and noticed this crack in the carburettor primer plate where the return pipe leaves the carb. A phonecall to Nitrotek has a replacement on the way. Meanwhile, I have dismantled the plate and filled the crack with resin to see if that fixes it.
A tyre started to come off the rim. I used superglue gel on it, this fixed it and it was up and running again after a few minutes

I know little of these cars, so as I say I apologise if this is the norm.

Ahh i see, you are reading the blog i found of another user who experienced the same issues as me, although he decided to repair his. That is just a little bit of evidence i found to back up my case.

    Thanks

Yes, you still need to raise the formality. Stop emailing them and write giving them 7 days to agree a refund. If they don't issue a summons.

Ahh sorry Jason, and I was sober last night too! :p

I think its time to stop emailing and send them a 'Letter Before Action'. There is a nice template here:

    http://www.consumerdirect.gov.uk/after_you_buy/making-complaint/template-letters/letter_before_action/

Make sure you send it recorded delivery so the company can't feign ignorance.

If that is ignored its time to file a small claim. You can do this online:

    https://www.moneyclaim.gov.uk/web/mcol/welcome

For claims up to £300 its £25 and £35 from £300 to £500, when you win you will get that returned in costs so its always worth a shot.

Probably the most important thing now is to stop emailing. Keep a paper trail, all correspondence must go recorded with delivery evidence saved.

Good luck mate, and apologies again for getting the wrong end of the stick.

Hi All, just to let you guys know that my Allocation Questionnaire arrived and i was filling in ready for court. I had looked through the defence and i was pretty confident i must say but i still had some doubts.

I thought i would try one more time to appeal to these guys and thank god they have agreed to resolve the issue.

I would just like to say thanks to the help you guys gave.

I will be contacting the court tomorrow with the news and to see what i need to do.

    Thanks
