vodafone early cancellation of contract (data charges)

Hi all just after a little advice...

I took out a 24 month contract with vodafone last september costing £25/month with a nokia N97, 300 mins unlimited texts, stop the clock and "unlimited" internet. After three replacement phones and many hours on the phone to customer services I gave up on the N97, bought myself an iphone and sold my N97.

Now vodafone have decided to charge for exceeding 500MB which this month I have exceeded by 400Mb (world cup on tvcatchup) I noticed a clause in their anouncement stating if my bill is more than 10% over last months i can cancel, (look in the vodafone forum for announcement-137-updated-mobile-internet-charging. I can't post links as i'm a new user!)

My query is if I cancel will I be able to port my number and will vodafone want the N97 back?

    I would have thought so, but does it not also say you need to notify them of your intention before you actually incur those charges? Not sure how you're meant to do that, as you didn't know they were going to charge you! I guess I'm reading that wrong.
    we increase your charges in the UK which have the effect of increasing your total charges (based on your usage in the previous month) by more than 10% and you write to us before the increase applies;
  • Hmm yeah strange that here's what the announcement says:
    Can I terminate my agreement because you have changed your charges?

    Your contract allows you to terminate if the changes to our charges means you have suffer an increase in your total call and usage charges by more than 10%. This will be compared to your previous month’s usage. However you will only be entitled to terminate once we have introduced those charges – this will not happen unless or until you have continued to exceed your data allowance and we have notified you that we intend to charge you.

    You will need to send us written notification that you intend to terminate your contract and this must be sent to us before the charges are introduced (we will give you at least 14 days notice).

    Who do I write to if I feel that I have a right to terminate because of these charges?

    You will not be able to terminate unless we have sent you a notice of our intention to charge you for out of bundle data usage. If after receiving this notice you feel that this has increased your total usage charges by more than 10% then you will need to write to us informing us that you want to terminate your contract. Please send your written notice to: Vodafone UK Ltd., Vodafone House, The Connection, Newbury, RG14 2FN.

    I would contact vodafone but I think that they would decide not to charge me so that then I wouldn't be able to cancel. They have phoned me to try and sell me and extra 500mb for £5 and told me that i would be charged 50p for every 25mb but I thought best to wait till I get the bill so that they can't knock the charges off.

    Probably best, as there is no way that they could really argue, that you were in a position to notify them before you even knew you'd incurred the charges. Keep me posted, I'm considering what to do on this one.

    They have said they will allow you to go over for 2 months (they will send you text messages advising you that you have gone over) and thenon the third month they will contact you to inform you that you will be charged £5.

    At that point you have to contact them and tell them you wish to cancel.




    My advice to anyone with vodafone who is on unlimited internet is to hammer data usage, best way leave it connected to charge and stream over night to be sure oh and install a couple ofskynews widgets they eat a ridiculos amount of data.

    I really couldnt believe that they tried to introduce these charges to existing contracts and not just apply them to new contracts and upgrades. Idiotic decision, but one which helped me get my contract cancelled recently.

  • Did you have to return your phone then? And were you able to port your number? I've had mine for the last 6 years so I'm a little reluctant to get a new phone number
