Hold on hold on...I came for help not personal attack. I suffer with enough mental health issues as it is...I don't need that kinda thing dragging me further down. Advice/help is all I want.

My partner could never afford to pay for a car herself. The money paid out wasn't anywhere near enough to cover the finance with Welcome. The car bought in replacement was 3k not that it's really the issue.

I just wanted advice as per the original post :(

i never said cover the finance
i said get them off your back
nobody is going to give you a get out of jail free card here
welcome need paid and the did provide you with a car

The bit I do not understand is, what difference has the car being written off made to your ability to make the payments?

I just think civility is a small thing to ask for. Once more, I know i'm in trouble - I just want to know the consequences. As for what you said about my "ills" - back off now! You have no clue about me or my illness...and you are out of line. Post reported.

I do not think custardy was out of line, just honest if maybe a little blunt. The finance company will take no account of your state of mind. You need to address the issue from a purely practical rather than emotional point of view.

Unless i've misunderstood something along the line, the insurance payout from the other side paid for the new car, so how is it affecting the repayment ability? Or have the insurance paid out so much, and you've put the rest towards it?

If the car was on finance, it will of been on the hpi register. If this is the case, the money belonged to the finance company and you would be liable for the balance. Suppose you could use the personal injury money to pay them off.
  • You need to speak to Welcome and be upfront with them. Do they know the car has been written off?

The two issues are seperate, you can't pay the finance, they will come and hassle you and eventually want to repossess the car.

In the meantime the car is written off. As PNPSUKNET says, that insurance money should have gone to them. It hasn't so you may have to sell the new car and pay back what you owe, or get back up to date through some sort of repayment plan.

If you HAVE to keep the new car, it needs to b registered as your girlfriends as if you owe money it is an asset that you have. I see you are trying to do nice things for your girlfriend but you are getting in a serious financial pickle. Is there not anyway she can help? Friends, family?

Perhaps as the other poster said, if there were injuries you may get some money there. Good luck.

PS. I don't think its appropriate to bring your illness into the arguement with the other poster.

Why does your GF work over 50 miles away if you/she can't afford too?

Can't she get a job closer? Might mean a pay cut, but then your not forking out for a car and all that entails.

clairbear thank you for your help.
The financed car was registered and insured to her from day one, it was just the finance in my name. The new car is registered to her so I have no ownership rights on that whatsoever. None of the money came to me at all from the insurance, it was all hers. So yes I know I still owe them, and I will try and work something out with them, I just know how hard they can be and was a little worried on what they will say over the whole written off thing.

You're right, I shouldn't have brought my mental state into it. In the original post it was mentioned purely to ilustrate my desperation for advice. It's not a defense at all, i'm not trying to make it that way...i'm just very worried.

    Thank you for understanding.
