PayPal - Credit card chargeback successful, but now I owe THEM money?

    Jezzebel can you explain what your situation was? Am a little confused about your situation above.

    It sounds like you may have possibly been getting or at least heading for a double recoup of the money, but in this case for me it's not like that unfortunately :(

    yes thats what it was! Paypal told us that the bank would refund us AND paypal would refund us and as soon as the refund was received from paypal we were to pay them the money back! Something about paper trail auditing etc! As i said we never did receive a refund from them though.

    As far as I can make out, and to my understanding, legally PayPal are just the money agents and thus any claims are with the seller; you shouldn't have make a chargeback against PayPal. At least for items outside of ebay (and definitely before June 1st when PayPal's policies changed). Thus, I'm not surprised PayPal are asking for their money back!

    However, as pointed out PayPal's policies seem to be something of a maze and their communication isn't good. Hence, the statement in T&C's saying chargebacks being allowed and possibly telling you to do such, then when you do complaining about it!

    Either drop it and hope they don't come chasing after you or keep trying to escalate it direct with PayPal to see if you can get a proper explanation and see what the situation is. I doubt anybody but them actually knows what's what (and I wouldn't be surprised if their junior level support is also confused!).

    That's the only recommendation I, and I'd think anyone else, can sensibly offer. Good luck with it.

    Well although we dont know 100% of what exactly happened, as already explained to you......just because the chargeback fufilled your CC issuers requirements, doesnt mean it fufilled paypals. They are not operating under the same policies (although obviously they do overlap to at least some extent).

    You would have to contact paypal to try and resolve the issue with them. Also, it would be a good idea to get in contact with your local CAB to see what assistance they can offer you.

    If paypal can get the money off the seller, then no tears.

    However if the seller has been bright enough to empty their account a bit quick, then tears because paypal ends up losing.

    Paypal are quick enough to take other people's money, but don't like having the same thing happen to them....

    Didnt you say yourself that you werent covered by SNAD terms that were implemented on 1st June 2010? You agreed to abide by paypals terms and conditions by using their site.

    By paypals standards, you werent entitled to refund or they themselves would have processed it. When you paid for the items, paypal then passed that money onto the seller.

    When you actioned the chargeback via your CC company, it took the money from paypal even though they no longer had your money.

    TBH you should contact CAB. They'll be able to tell you whether Paypals terms may come under "Unfair Contract Terms". Ultimately, you should also contact paypal and discover what exactly their position on it is, how it will affect you and more importantly, if you dont pay what the consequences are.

    unholy thanks for your input, although to understand the entire issue of being covered/not covered for this by PayPal I think you would need to read the entire thread and also the Terms and Conditions in detail.

    Really the whole thing looks like a grey area, may be one for the Financial Ombudsman?

    I did read the whole thread. Instead of issuing a small claims against the seller, you issued a chargeback against paypal - who dont actually have your money. And while i personally think you were entitled to a refund, paypal obviously did not.

    Hence why i told you to go to the CAB as they would be able to advise you on what action is best to take next.
