As far as Paypal are concerned, you have taken monety from them, not the seller of your item, so naturally they are going to want the money back if you want to use your account again ever.
Why didn't you return the goods and get a refund?
Why wouldn't Paypal support your SNAD?
What were the goods and what was the problem?
Post the item number if it was eBay.

TBF, he said in the other thread it was a classified ad, not bidding or buy it now. Classified ad's you basically fill out a contact form, those details are then sent to the seller who chooses to contact you or not.
Even from ebays own site when saying when to use Classified Ads:
Use this format when:- You want to generate multiple leads and complete your transaction off-eBay.
So how exactly was he supposed to go about it?
Also, i may have missed it given the time of the morning but where did he say he had sent the money via paypal as a gift?
What he should have done all depends on whether the seller was a trader or private seller. As obviously, your rights vary. You keep using that word. Paypal have the right to refuse to allow people they consider to have misused the system to have an account. That is clear in their terms and conditions.
So you have your money back and you have lost your paypal account which is exactly what they warn you will happen. A long as you never want to use paypal or ebay again you will be fine, and maybe as you failed to understand how paypal worked in this instance it might be safer not to have an accountI’m a Forum Ambassador and I support the Forum Team on the eBay, Auctions, Car Boot & Jumble Sales, Boost Your Income, Praise, Vents & Warnings, Overseas Holidays & Travel Planning , UK Holidays, Days Out & Entertainments boards. I find it strange paypal wouldnt refund for this. I once purchased a dvd that had a superglue like substance on the rear which meant that around 30 mins of the film couldnt be read. I tried contacting the seller and received no response so paypal refunded me and usually all they ask for proof of return is that you send it recorded delivery.
Are you sure theres nothing that you've forgotten to tell us?
And remember, paypal and your credit card company do not have the same motives in mind. According to paypals terms, you were not entitled to a refund. Just because your cc company have validated the chargeback doesnt change this

The OP is quite correct in that as the transaction was pre June 2010 and NOT on ebay he had no protection at all for SNAD items, therefore the only way to force a refund was a CC claim.
OP, I don't believe they will chase you for the money as your letter is not the standard one. They are merely saying that they have reserved the right to refuse you access to the account unless you cover the chargeback. That is fairly normal and if anyone ever decides to go for a CC chargeback on the ebay forum (see my sig) we always warn them that it is likely it will cost them their account.I’m a Forum Ambassador and I support the Forum Team on the eBay, Auctions, Car Boot & Jumble Sales, Boost Your Income, Praise, Vents & Warnings, Overseas Holidays & Travel Planning , UK Holidays, Days Out & Entertainments boards. In order to be covered under Section 75 there has to be a direct link between buyer and seller. AS you are using a 3rd party (PayPal), section 75 would not apply.
Ultimately when you give Paypal money, you are contracting them to transfer your money to the seller. You are not buying the product from paypal.
If you are not bothered about losing your paypal account, do as Soolin has advised above. Alternatively, you could return the money to paypal and then take the seller through small claims court.0 -

When you say "According to paypals terms, you were not entitled to a refund" can you elaborate on this a little? Obviously once I went down the route of CC Chargeback I waived my rights to PayPal's claim/dispute process.
Also, when you say "And remember, paypal and your credit card company do not have the same motives in mind", again can you elaborate?
Still somewhat confused here.
The amount of the transaction could be why paypal rejected it. Mine was only for a tenner so HUGE difference lol.
You said you went through paypals dispute process but your claim was rejected........and paypal have two people in mind equally when conducting chargebacks (buyer and seller) however your credit card company tend to favour the buyer more and their own requirements of things that need to be done in order to action a chargeback is not necessarily the same as paypals requirements.
Any clearer? Its 1030am which is like midnight to me (i work nights), so my brain doesnt always want to work
