Just send it back to play then stating that you believe it is false labelling. If you want multi tasking then possibly look at jailbreaking it, you get custom backgrounds etc as well then.

Thats true you can't jailbreak 3G on os4 yet, or at least you couldn't at 2pm but who knows now.

also i didnt state this but i bought the ipod back in february the 12th.

Honestly I reckon you'd be better of sending play an email asking this. Explain your situation and see what they come back with, you don't ask you don't get!

The apple website states that iOS4 works with late 2008 2nd generation iPod touch. It also says multitasking is not compatable with 2nd gen devices. So either way you don't get that feature

This is correct - I have the same model as the OP, bought around the same time (but from Amazon), and it has upgraded to ios4 today without any problems, apart from the stated lack of multi-tasking.

Apple didn't announce OS4 until April, so you couldn't have purchased it with the intention of upgrading the OS, as no one even knew Apple were going to upgrade it.


I think you'd be very lucky if they will accept a four month old touch back as a return in these circumstances.

well which is it? you said you wanted the OS4 upgrade but now want money?
play sold youthe only 8GB touch available from the Apple range with the current(at the time) OS
