    Won case through Ombudsman 2 months ago, mortgage just now back where it should have been if CB hadn't made the error. Full repayment of arrears including the extra 5 months it took for CB to provide final offer and original £200 "goodwill gesture" I hadn't asked for in the first place. Well worth the hassle, on a point of principle as much as anything. Shame the bank hadn't the decency to accept responsibility and fix 8 months ago!
  • got a telephone call this morning from a lady at the f o s telling me that the clydesdale are to write off the £4000 shortfall. its many thanks to the people who have posted on this site that have helped me and so many others beat the bully bankers. to those awaiting a decision,hang on in there.power to the people !
  • just to add to the list of successes, we went to the financial ombudsman in nov and were dealt with in about a month, with the verdict being the now standard "clydesdale have to write off the full amount" :)

    they stalled for a while over the 4 weeks containing xmas and new year, but a short email to the ombudsman to give them a prod worked immediately and we got confirmation of our refund of 5.9k last week.

    it really is worthwhile going to the fos to get the full amount of the underpayment written off :)

    I've found this forum really useful to date and am pleased to hear of all the good results!!

    I'm about to make the formal complaint to the FOS after having gone through the communication with Clydesdale and receiving their final offer, but I'm a little bit unsure about what I should include in the FOS complaint form.

    Can anyone let me know what they put in the 'please tell us what your complaint is about' section?

    I just want to make sure I don't miss anything out and make it clear what I'm trying to acheive, so a copy and paste from someone that's been successful would be ideal...

    Thanks for your help!!

    One of the good things about the FOS is that it doesn't expect your raising of the complaint to be in degree standard English.

    In other words, keep it to the point.

    - what they did that's upset you.
    - how much it's cost you (if you can quantify it)
    - why you're not happy with their proposed solution.

    Take it from there.

    The fact this firm are still forcing customers to go to the FOS is an absolute disgrace. The FOS should ask the FSA to force them to apply the same refend principles to all affected customers. This will save everybody a lot of effort.
  • just to let you know metalfish.after being fobbed off by the clydesdale, i phoned the fos and the chap that i spoke to filled in the majority of the complaint form for us as we spoke. all we had to do was sign the form and send it back to the fos with all documentation we had recieved from the clydesdale. within a few weeks i had recieved the call that our shortfall was to be written off,and all for the price of a phone call to the fos. hope this is of help

    clydesdale are writing off the shortfall- £5000 and giving £50 in compensation. I'm so glad I found this site!

  • Forgot to post an update when this finally got agreed back in Nov 10 but the Ombudsman found in our favour and wrote off the initial £7k shortfall and the additional £2k shortfall that built up in the time it took Clydesdale to pull their finger out.

    So a £9000 credit on my mortgage statement at Xmas was very welcome.

    Why the bank didn't act back in June 10 is beyond me, it would have saved them another £2k in shortfall and me a lot of stress but then this amount is so insignificant to them it probably wouldn't have covered the champagne bill at the Directors Xmas party.
  • Yet another result. Clydesdale are writing off the shortfall of £5000 and giving £50 in compensation. I would urge those who have suffered to go through the Financial Ombudsman Service as you will win.:T
  • Got my letter from Clydesdale. They have credited back £5911( a bit more than I had thought) and paid an additional £50 to our bank account.
    Just incase the info helps others- we now will be paying £872 monthly instead of £900.

    This is money I probably would have not got if I hadn't found this forum. Thanks so much to everyone.:j
