  • Another victory for me - received a call from Yorkshire Bank yesterday to say they were prepared to consider writing off the amount I had underpaid - only £1,500 for me but a victory nontheless. I did all the work myself and fortunately didn't need to take as far as Ombudsman. Well done all.
  • Mmm, ombudsman has been very helpful both on the phone and by letter...however...it's taking so long!

    Yet another letter this week...."we're still analysing your case".

    I wonder if CB is delaying or if there is just an overwhelming number of cases.

    £7.5k deficit here and still hopeful...cmon FSO, decision please :cool:
  • Thank you so much for this thread without you we would be £2000 worse off

    Recived a letter in June stating that we had been underpaying our mortgage etc. and had underpaid by £2000.

    Complained to YB but got fobbed off and at first thought oh well there is nothing we can do about it. Read this thread and thought they are not getting away with this. Complained to YB and eventually got offered £300 compensation .

    Wrote to the Ombudsman on 22nd July sent all the information, we were kept well informed by the Ombudsman of the position of our complaint. Yesterday we received a phone call to tell us the Yorkshire Bank had agreed to write off the shortfall.

    We now will wait to see how long this takes as they have been taking the increased payments, which means we will have been overpaying for 3 months so far.

    Good news

    A very nice man from the ombudsman phoned today and stated that he had assessed all the details of my case and has ruled that the Clydesdale Bank are fully responsible for the capital shortfall caused by their miscalculation of required payments. He stated that there was no way I could have reasonably known that the payments where wrong.

    He has instructed the bank, and they have agreed, to pay the whole shortfall and bring my mortgage to the position it should have been in at this date, if the underpayment had not occurred.

    The sum involved by now is almost £8000 so needless to say I am ecstatic! Well done ombudsman.

    My payments will still rise to what they should have been at this stage but that is as expected.

    Keep at it folks, the rulings are going in our favour!

    He also stated that Clydesdale now have 4 weeks in which to "sort out" my mortgage. In all the cases he has dealt with only once did he have to prompt the Clydesdale as they were taking too long.
  • Hiya, just heard from the FOS - our claim has been agreed. FOS seem to be just sending a letter to the CB with a hyperlink to the FOS guidance on their website i.e the same guidance we referred CB to back in June !

    Off to the pub to celebrate ...... :beer:

    Major relief! Just heard from FOS via letter to say that the 'Clydesdale Bank has agreed to waive the capital shortfall and any incorrectly charged interest.'

    This is worth nearly £4000 to us - so we are really pleased with this settlement.

    It was worth all the hassle. I just hope that more and more people get to hear about this - I think it's outragous that the bank are not being upfront about this and voluntarily writing off customers' shortfall. I really wish that the FOS had the authority to make a blanket ruling on this.

    Keep going everyone - thanks to all for your postings - it kept us going during this battle.

  • :mad:How to I get started - complained to the bank in July. Was told that as I was coming to the end of my discounted period and the new rate I would be paying was still the best they had. There was no point in complaining & I should just pay up. ( extra £120 a month) After reading this blog I want to take it further but am I too late? Can I go straight to FSO or go through Yorkshire Bank HO. Can anyone advice. Great news to you all!

    No- you are not too late. Phone FOS and explain what you were told. They will advise the way forward. Good luck!

  • Suggest everything is documented.

    Reply to the bank formally rejecting their offer, and ask for the miscalculation to be written off as it's their mistake.

    They normally write back offering you (more) compensation.

    You then need to write back formally rejecting this, and restating that you want the miscalculation to be written off as it's their mistake.

    They will then write back with a final offer.

    You then write back REJECTING this final offer, stating that you will be taking the case to the FOS.

    The FOS will then take it from there. The first thing the FOS asked me was had I had a final offer from the bank in writing?
    You will need to keep all correspondances to send through to the FOS with your claim.

  • got a bit fed up and decided to phone mr nice man from ombudsman as hadnt heard anything since beginning of this month - he called me back and said oh good timing I had sent you a letter on monday (hope to get it tonight when get home) - they have completed their investigations and upholding our complaint against the Clydesdale!!!! wooooooooooooooooo hoooooooooooooooooo :j:T

    he said that they found we couldnt be held accountable/responsible and have requested to Clydesdale to write off 100% of the shortfall so therefore we get to keep the notional saving of over £1700, they've also requested the bank to restore our monthly payments as they would be so that the mortgage term is not affected and we might even get a little money back seeing as we have been paying an increased amount since July - am not getting excited but it could be a little xmas bonus of £50! :rotfl:

    cant wait to read my letter, sign and send back to them!!

    Well done to those who have had a good outcome and keep going to the peeps who are still waiting on a decision - it looks good folks!:)
