Had a phone call off them today asking what it would take for me to be happy that this complaint had been resolved I said if they took the hit for all of the arrears as I had read that the FSO looked favourably at the complianants in recent cases.
So that's what she's going to pass onto this "dedicated team".
Oh and I also asked what my monthly payment should be without the arrears - anybody had this info yet? As obviously we're still getting further and further behind.
Cheers

Can't believe this s still going this thread might have the record for one post wonders.
As I posted before somewhere.
Most of the increases people are paying is to bring the payments up to what they should have been paying all along.
the extra for the actual mistakes are small.
The lender realy messed up sorting this out by not seperating the two parts.
Paying what you should have been paying is something no one can justify complaining about.
Seperately resolving the underpayment issue would have been much smaller numbers and not caused so much trauma and media reaction.0 -
yes indeed why would anybody complain about the real payments!!!
I'm just surprised that they haven't asked at least for at least the increased payment - but they hadn't until I prompted them.
Just posting to keep people in the same situation up to date!!!

the FOS guidance indicates where the bank screw up they take the hit not the customer, who has maintained in good faith the payments that the bank asked for. If the customer fails to make payment when asked they are in breach of contract - we were not asked to make payments creating arrears of capital repayments. This is documented by the FOS since 2001.yes indeed why would anybody complain about the real payments!!!

My understanding is the bank suspended the auto-uplifts where complaints were made i.e. for the 8 week duration of the complaint. I think, need to check the capital debt was forecast at 'X date' in Aug'10 the point of change. If the bank has fails to resolve the complaint in the 8 weeks prior to the Aug'10 start point for the increased payments - then the capital debt will grow.0 -
An update! Have spoken to the "dedicated team". Got only lots of apologies and no clear strategy - including no stated criteria at all. They claimed to be treating each customer individually and looking at each person's circumstances. Of course, unless they are means testing and scrutinising expenditure this is impossible! So have now made an official complaint and requested that the entire shortfall be written off. Will keep you posted. If they do it for one they have to do it for all!0

I am currently waiting on a call back from the Clydesdale bank on Thursday, this follows another call I made to them on Tuesday to complain about their ability to accurately deal with my mortgage account. Not only did I have the letter telling me about the underpayment but when I got the breakdown of payments I noticed that they had not offset my account for the first 7 weeks of my motgage. I had to inform them off this and this resulted in the bank repaying money into my mortgage account. When I expressed that I felt that I could not trust the bank any longer ( I have been a customer for over 18 years) I was offered a goodwill payment of £150. I was told that if I accepted it I was basically saying that I would take no further action. Having read the threads I realise that even as a goodwill payment this is an extreamly low offer. The call back on Thursday is to see if I will accept it. Having read the threads I now have more confidence to say no and that the blame for these errors lies firmly at the feet of the bank. As I said to the advisor, this is just money to the bank but it is a house, my home to me. I wish everybody well.0

Thats OK but the payments still need to go up and most of the increase will be to fix the payment to what it should have been.

That's the point they meesed up the payments then the resolution of the problem.
They should have seperated out the required payments from the problem of the shortfall.
What is significantly more worrying is the nmber of people that clearly don't have a clue about their mortgages and blindly just accept what their lenders tell them.
In the cases that I have looked reported here the shortfall was not just a missing bit of interest they were below the interest only amount required to pay of the debt in the term, this should have jumped out at people0 -
had a phone call yesterday offering me £1,000 compensation - letter arriving next week apparently with details of the ombudsman etc.
Anybody else had any joy?0 -
It can't be a coincidence that FOS chose to release this today.0

Hi All
Just received a letter from the Finiancial Ombudsman saying that our case hes been reviewed and the Clydesdale Bank will pay the full sum of £1147.99
:j
I had been offered £150, then £200, and finally £600. We just kept of refusing until we got their final offer, took our case to the FOS and 2 weeks later, all sorted
Just keep at it everyone
