Maintenance Fee Charges...

Can anyone help please?

I've an apartment that I've had for over 10yrs and I've always paid the maintenance fees on time and in full. The property has an on-site pool and gym which is all included in the fees so I can use them free of charge.

Recently the maintenance company has written to every householder asking for an additional £200 to cover the major repairs that need to take place on the pool foundations (the pool is currently closed due to the issues).

Do I have to pay this? Surely this should come out of the maintenance companies pocket as they are responsible for the upkeep of the pool. If there is a shortfall in money to fix the problem then it should be their issue not the apartment owners!!!!!!????????

    If there is a shortfall it is the responsibility of the leaseholders to pay it, not the management company.

    If you are unsure of your responsibilities, it would be worth contacting the Leasehold Advisory Service.

  • You can ask for a list of costs for the repairs. The management company should have an emergency fund for unexpected repairs you could ask about this, but ultimately the leasholders are responsible.

    Service charges are usually payable in advance and, as such, are an estimate of the cost of repairs and maintenance for that financial year. Any adjustments or major works are chargeable on top. Nothing comes out of the maintenance company's or freeholder's pocket - all repairs and maintenace detailed in your long lease are solely chargeable to the leaseholders.

    Not all blocks have a sinking fund, these are only allowed if there is provision in the long lease. Even then some freeholders opt not to change extra and build up reserves.
