Phones 4 U (online) contract with Vodafone

Hi,

I took out an 18 month contract online with Phones 4 U in July 09. The phone (Samsung Tocco Ultra) is about to go in for repair AGAIN as the battery life on it is horrendous (I have to charge it twice a day!) and it's generally very slow. I'm moving to Canada in August for a year (obviously I wasn't planning to do so when I took out the contract last year) and I'm wondering what my best option is with this contract?

I will need a phone in Canada and would rather not take this one as it is so unreliable and will cost me a fortune to phone/text home. Should I cancel the contract or try to reduce the monthly cost or something? I really don't know what to do with it. No-one will buy it off me as the phone is a nightmare (even after repairs). I've never been with either Phones 4 U or Vodafone before so I'm not a loyal customer! Any suggestions will be much appreciated. :)

    If you call Vodafone to cancel the contract (or pay up your minimum term) they will work out a cost for you - it will be monthly tariff x amount of months remaining - 25% discount - VAT

    I would look for an exit under "not fit for purpose" and make a statement that you reject the phone (insert grounds) and request they terminate the agreement at nil cost to you. If they refuse, as they most likely will, then you must look to your consumer rights as they have sold you a lemon.

    Your contract with Vodafone is for the airtime which they provide.

    The handset would have been provided from from Phones 4U stock and any handset problems are their responsiblity.
