Banks illegally requiring donor's signature to use Enduring Power of Attorney? Help!

    Not it is not registered, They checked in the branch on Saturday. We have been told that there is no customer number to ring and that the department ' are very busy and have the whole of the country to deal with' We live in hope

    Aargh, have just had a call from Yorkshire Bank (woman on holiday for two weeks so slow) and she tells me that they want my mum's signature because it is more than 6 months since she signed the enduring power of attorney! It's an enduring power, not a six month power! I explained that she's in hospital and very weak and that it's exactly this sort of situation that the EPA is designed to protect people from - having to sign stuff and deal with financial stuff when they're extremely ill. God, I'm so angry! Had a good but civil go at her and insisted on talking to their legal dept directly if they will not change their minds. Whichever way it goes I'll be writing to the FSA about their procedure. Why they expect their customers to repeatedly confirm that they weren't morons when they signed their powers of attorney is completely beyond me. Aargh, so angry!

    On the plus side, Britannia were brilliant and registered the EPA during the 40 minute session that I was with them. Zilch from Santander, still hadn't registered me last week and I had to insist they looked it up on their system without me having to come into the branch. Nationwide also good. Halifax OK.

    Will be moving my mum's money out of Yorkshire Bank and Santander as fast as I can shift it and telling them exactly why. I will also write to their head offices. What is wrong with these people?!!

    Drop them a line.

    Remind them that:

    • You told them on Saturday 24 July that you were dissatisfied with the time it was taking to register the POA
    • Under the FSA's "DISP" rules, they had to either resolve the matter to your satisfaction by the end of the next working day (Monday 26 July) or refer it to their Complaints Procedure.
    • As you have not had the matter resolved to your satisfaction you look forward to receiving their prompt written acknowledgement of the complaint and them issuing their final response no later than 18 September, as required under the same FSA rules.
    No you don't want to wait until September but that is not the point.

    The letter can go to any branch. If you snail mail it, don't bother with recorded delivery but do get proof of posting (free from the post office).
