car dealer selling car with no V5

What rights of cancellation would you have in this senario ?

you buy a car from a main stream dealer, agree a date to pick it up.

on said date of pick up car is found not to have V5 so dealer wont sell, 4 weeks on and still no car and no V5

finance co want their money even though no car supplied and contract cancelled with finance co, but finance co have paid car dealer

    Get on the car dealers case I don't no much about this topic so can't really say much more. But I'm pretty sure they can't sell the car with no v5

  • Is it a loan of a hire purchase agreement?

    If a HP, just phone up finance company - tell them dealer has not given you the car, and you are cancelling the agreement, as it has not been fulfilled - follow up in writing.

    If you have a personal loan - go to dealer demand either car NOW with paperwork or money back. Oh and by "go to dealer" I mean go down, preferably with a screaming 2 year old if you can manage it, bring a book for you and some loud toys for the 2 year old - then demand your money back. Escalate it gradually over a period of about 10 mins.

    No - not a cheque - go down the bank and get cash

    This is all better done on a weekend, preferably when there are a few other customers about. Of course the dealer may be just as frustrated as you, so do be reasonable at first (don't walk in shouting!) but be reasonable but firm. Your aim is to walk out with cleared funds - either cash, bankers draft, or onto your debit card - how you get there doesn't matter to you - so give the dealer a chance to get you the cash.

    If he doesn't play ball - start feeding the 2 year old coffee


    Hang on just noticed you said contract cancelled with finance company - if that is case - why is it your problem?
    Unless it is damaged or discontinued - ignore any discount of over 25%

    It's not illegal to sell a car without a logbook, but on the other hand, it's not difficult to apply for one. I'm curious why the dealer is making such a drama about this, maybe the car isn't what it should be, or failed HPi. (That should have been picked up by finance house though). The last thing the dealer wants is a recharge by the finance co. so use them as leverage to sort it out.

    Yes hp, in-law got letter yesterday from hp company saying you owe us xxx because weve paid the car dealer for your car, surely its just a case of dealer sending back the money to the finance co saying customer cancelled deal, and the fact that no goods have been supplied as yet ?

    I'd say speak to trading standards. Is it a main dealer? If yes then speak to their customer services. Also try and write a letter to the dealer principal of the dealership.

    I think I would contact the police as this is basically a fraud matter. If the dealer has been paid and not delivered the goods to customer and signed up for the customer to a credit agreement then it is fraud. I can't understand why you signed the paperwork though? When I got my brand new car via HP I didn't have to sign anything until the few seconds before the keys were handed over.

    Tell the finance company that you haven't recieved the goods and since they made the payment could they try to cancel it? Also try trading standards, if no luck try the police.

    If you are still not getting anywhere have you considered contacting Watchdog? They do seem to make a difference in a lot of cases when they get involved.

    If the dealer hasn't bother to supply your car after 3 - 4 weeks then don't expect the dealer to contact the finance company. They have their money already. Is it YOUR name on the agreement ?? - not theirs

    I would make absolutely certain that the Finance Company know that you cancelled and the reasons why. And I would do this verbally and with a recorded letter.
