help with esa support group

  • hi, im new to the forum and hope someone can help.

    I've recently won a year long battle with esa.
    I was declared fit for work scoring 0 points in the medical, then turned down in the written appeal.
    Last month i finally had my oral hearing, and having scored 30 points within the first 2 minutes of the hearing, the case was declared a no contest and i was successfully awarded esa. The doctor went as far as saying "a blind man on a galloping horse could see that you are incabable of work".
    Now today i recieved a letter stating that i was put into the wor related activity group instead of the support group and am once again quite distressed.
    When i called esa the girl i spoke to wasn't very helpful in regards to information. She said that the support group is only for terminally ill people.
    I'm extremely confused by the whole situation and have been trying to find a list of criteria that needs to be met to recieve support group status.
    Can anyone please help? Either with a link or a list on this topic?

  • The truth is this new benefit has nothing to do with being fit or unfit for work. It is a Conservative attempt to get you off sickness related benefit and on to a lower paying benefit. They don't care if you are ill or how much stress you suffer because of it. They claim the country is skint but still spend billions on a war that has nothing to do with us and give away more each year in foreign aid than they spend on benefits.

    The Labour party brought in ESA not the tories/Lib Dems

    Firstly, I'd recommend phoning, and making an official complaint against that person.
    http://www.dwp.gov.uk/docs/m-06-11.pdf - support group criteria are at about page 14.
    There are a good number, and it's certainly not only for terminally ill people.

    hi,
    the original assessment was 26 oct 09,
    the tribunal to appeal this decision/ medical was won on 27 may 10.

    i recieved a letter stating i have been placed into WRAG based on the medical on 26 oct 09.

    is it just me or would common sense not dictate that they are incorrect to place me into WRAG based on a medical that initially said that i shouldn't be eligible for ESA at all, which was then overturned at tribunal?

    I am confused.

    Are you saying that you disagree with a decision that was made in May 2010? If so, you are out of time for appealing that decision.

    What you need to do is to seek a supersession of your existing claim on the grounds that your condition has deteriorated since the original decision was made. Do you have a DIAL office near you? Or is there a Welfare Benefits Advice service (possibly at your local CAB?)
    I'm a retired employment solicitor. Hopefully some of my comments might be useful, but they are only my opinion and not intended as legal advice.
  • I did not have to attend a fitness for work interview but was put into a work related support group. This was despite me taking several epileptic seizures a day coupled with other mental health problems and needing a carer daily.

    I appealed the decision with the help of a letter from my Consultant and the support of the the CAB and two weeks later was put into the support group. I advise you to go to the Citizens advice Bureau and get covering letters from your Doctors.

    i am on dla top rate for both mobility and care, just filled in my esa50 form and posted today how long will it take before i hear anything from them ?? feel sick with worry already !!:mad:

    The system is taking a very long time at the moment, it could be a few months before you hear from anyone (or it could be tomorrow)!
