help with esa support group

To be placed into the Support Group of ESA you have to show that you satisfy one of the descriptors in SCHEDULE 3, ASSESSMENT OF WHETHER A CLAIMANT HAS LIMITED CAPABILITY FOR WORK-RELATED ACTIVITY, of the ESA Regulations.

Clear concise information that i hopefully can use.
Is that the official criteria? and can i reference it in appeal?

If it is, then i should have no problems whatsoever.
At my appeal i was given a checklist of the criteria which i do meet that constitutes as me having limited capability for work.

It is an exact carbon copy of the page you have referenced, only with boxes checked and points totalled.

I'm still eally distressed that given the ESA has been presented this information, they chose to completely disregard it and make their decision to put me into WRAG based on dated/disproved evidence from the original medical.

All signs point to incompetence on their end. I've been running in circles stressing over this for so long and no matter how hard you try they keep changing the goalposts at the last second.

Thank you everyone for your help and insight into how the system works. It has been a great relief just knowing that i'm not the only one having to stand up to the nonsense put forthby them.

Its boarderline harassment how they deal with people. A shame that the system has been exploited so much that they have become so untrusting and corrupt.

Yes that is the official criteria that you have to satisfy. You can reference it if you wish for any subsequent appeal if you so wish. Good luck with your appeal.

You can only appeal on a point of law. It would make sense to quote the criteria.

You can appeal if you were awarded ESA but put in the work-related activity group but you consider that you should be in the Support Group instead.

The tribunal would be free to re-examine the entire decision if such an appeal is made. Worth considering.

the way i see it i would rather just have it all over and done with, but if they need to re-assess then thats fine with me.
i have nothing to hide and have proved myself many times already under the most ridiculous of circumstances. Thank you all for helping.

My hubby has a neurological condition which is progressive, and he is also on DLA HR care and Mobility.
He also claims ESA and has been put in the WRAG, instead of the support group. He was shocked by this at the time as he is unable to work, but to be honest he has not seen anybody at all regarding an interview etc. Thats been over a year now!
So I wouldnt worry about it, they do look at cases individually and at the end of the day if you cant work- you cant work.

I have an almost identical set of medical conditions to survivor and i'm only 23, i have a full time job and have worked since I was 15 so not really sure why they are so insulted at being in the work focus group, can't you see it as a positive thing rather than greet over the extra £5 a week?
