'Lost in post' issues from the horses mouths

I know a lot of Ebay sellers state this but its actually worthless in law. Its the sellers legal duty to ensure the item is delivered to the buyer and no matter what caveats are put in the auction listing if legally challenged they would be found null and void.
I know this is hard when dodgy buyers are involved but thats the law.0 -
In respose:
Guess you did not get my point?
I have 100% feedback in the past 4 years on Ebay (would that give you some confidence?)
My point was that I make a point of stating that I always get proof of postage - and that 'losses in the post' are at the buyers expense.
I'm not an Ebay Trader or Scalper. I only ever sell one of anything. A lot of what I have sold has actually been very specalist and rare Historic Rally/automotive stuff that I have purchased but never used over the past 25 years.
I put this statement in to discourage the dishonest Ebayers - If you look at some of the feedback you will generally get a good feel for those that are 'at it'.
I have only once had something that I sold that didnt work (other than the Item I sent to France which arrived in bits!) when it arrived. I phoned the buyer and immediatly asked the buyer to throw it out and I credited them in full. As it was a low value item ( a historic gauge) I didnt even bother claiming from the Royal Mail, even although they were the ones who had probably dropped it!!!
While I agree that the statement may not be 'admissable in a court of law' this is not unusual in the UK? How often do you park your car and the 'disclaimer' says that 'you park at your own risk....etc.....' again not exactly a true statement!!!!
I'm fully aware of my legal responsabilities thanks, and If some of you would 'run a mile' that is your free choice. But does 100% feedback not give you a better idea of the person you are dealing with?
I do use Paypal as it is convenient, and does provide some small protection (for buyers and sellers).
I'm 100% honest and decent - my point was that others are not!I am NOT a Woman! - its Overland Landy (as in A Landrover that travels Overland)

Out of the 1,600 parcels I've sent for ebay about 10 of them have failed to arrive. But one of them was a laptop worth £130  even though I sent it by special delivery. Theres been about 2 of things I've bought which have never showed. The longest it's been to deliver an item was 2 weeks and it was only to 200 miles away. I could have walked there quicker :rotfl:2008 Comping ChallengeWon so far - £3010 Needed - £230Debt free since Oct 20040

question: is proof of posting just the normal receipt or something that you have to ask for specially0

It is different from a receipt in that it specifically notes the date/price AND the address to which it is being posted.
A normal receipt only show the date & the price of posting but NO destination.
Hope this helps.I am NOT a Woman! - its Overland Landy (as in A Landrover that travels Overland)
