    Hello everyone. Finally, the long wait is over...but i guess I needed to wait a few weeks more as my bank denied that my PPI was mis-sold. I'm not giving up tho, this is going to be one he!! of a fight!! I have received their response last week and I am now ready to send the 2nd letter together with 4 more complaints for 4 different loans(which is a result of topping-up)!!! I was hoping that the first one will be settled amicably, but they denied it so out goes 4 more complaints. The other 3 loans was sold to me when I was on a fixed-term contract (I was a 2 year work permit holder at that time). They sold it when I was less than 24 months being employed.
    They were clearly informed about the date of my employment as It was shown on the customer records copy they have sent me with SAR. They did not send copies of original loan agreement for the 3 loans so I really dont know how much I am claiming here. I only know the loan agreement number and the cost of the premium but I dont know how much I have paid for the total PPI with interest.

    Have I got a strong case? I dont wanna get dissapointed twice. In case they deny mis selling of the other 4 loans, Im going straight to FOS.

    You cannot use the FOS until you have either;

    • Recieved a final response from the bank.
    • Eight weeks have passed since your original complaint.
    Therefore check you meet the criteria, or the FOS will refuse to deal with it for you.

    Hi. can you kindly confirm please, When you say final response from the bank, does that mean their response should enclose details of how to complain to the FOS?
    and 8 weeks since the day I have sent them the 1st letter?

    Normally a 'final response' will be mentioned either at the top of the correspondence, or in the body towards the end of the letter. If you are unsure, post us up a copy of the letter, with the personal information blanked out, and we can tell you if it is.

    The 8 weeks is from the date you made your complaint, yes.

    With the reasons you have its possible you do have a case.
    Have the the policy booklet details?
    If not they should provide them free of charge on request.

    But otherwise as ZPPP says, wait for the final response before you complain to the FOS, or the FOS will only tell you the same anyway.

    However, if your complaint was totally ignored after 8 weeks we do then have rights to complain to the FOS, but it seems in your case they may be giving you the opportunity to write back with further information you may have, they will then reconsider.

    In the final response, they do normally let you know its "final" and enclose the details by leaflet on how to complain to the FOS, saying that they do sometimes mention in their replies that your free to do so if your unhappy with the outcome.
    Personally though if they have not enclosed the above, I would keep at them until its final.

    You could also mention that your aware that the FSA are punishing banks who have been rejecting genuine complaints, and for not investigating them properly.
    If you believe yours have been overlooked and not taken into consideration then tell them so.
    So any further info, just write it all in and ask them to reconsider before you decide to take matters further.

    Hi all. It has been 3 weeks since my 2nd letter to my bank. Never heard from them, not even a confirmation. But I am very sure they have received the letter since I have sent this via Next day Special delivery and it was signed received. Should I wait no longer for their response and complain now to the FOS? Thanks all! :A

    Hi Bei

    Give them a ring to chase them up, ask them if they are dealing with your case, if they try to say they have not received it then tell them you know they have.

    If they do try giving an offer on the phone, tell them you will only accept written correspondence only.

    Oh, can I ask you something please? I went to my local branch hoping to cancel the PPI on my current loan. I was told that whatever refund I may get would mean that it is also considered as their settlement with my complain and I can no longer proceed to the FOS. Should I continue, this would mean I am happy with their offer. They are offering less than 10% of the premium pain(it was a single premium insurance). Are there any truth to this?

    Hiya Bei.

    I believe once a refund complaint have been settled, then they see it that you have accepted, so your not able to actually make a complaint based on that matter.

    So if your happy continue to accept, or otherwise complain to the FOS instead, you can of course wait for other opinions on this first if you want to.;)
