Garage have made a warranty mistake

    So they have left a message asking you to call them about it stating it isnt covered under warranty and you have ignored this. Definitly not strengthening your case if they try and charge you for it.

    If they could charge him for it..... which they can't. That's a pretty strong case as it stands, and answering the phone won't strengthen it any further.

    No but when being told your car isnt covered by a warranty ignoring the phone calls isn't a reasonable course of action.

    The OP should have phoned back and resolved it.
    They also should have told the garage they knew the warranty was expired. They will know better than the garage the exact dates.

    Your "reasonable course of action", in these circumstances, would do nothing to strengthen his case. In fact your second statement looks frighteningly like an admission to an act of deception... a criminal offence. Perhaps you could explain how THAT would strengthen his case?

    No, they sent me an SMS telling me they had left me a message and asking me to call them, but there is no message.

    Why should I spend money phoning them just so they can ask me to give them more money - they can phone me back!

    Sorry, I disagree.

    I was sent an SMS, technically an unsolicited SMS as I only agreed to allow them to use it for service reminders and updates.

    I have had no phone calls from them since collecting the car and settling the invoice.

    Its a franchised dealer so they have full access to all of the car's history. They should have checked that the warranty was in place before authorising a warranty repair.

    I specifically asked if it would be chargeable and was told specifically that it was a warranty repair - therefore my assumption was that they HAD checked the warranty.

    I find it very hard to justify a fan failing after only 3 years and two months, the one on my old banger (A 1992 Sierra Estate) where manufactured in 1992 and as far as I can tell the bolts holding them on have never been removed.

    If I remember correctly the sale of goods act would state about the part being fit for purpose, which on a lowly stressed part like a fan, I would expect it to last a LOT longer than 3 years and so would most likely be complaining along these lines.

    However I wouldnt be tempted to use the garage again, if as a business they are unable to work out if a part is billable before fitting it to your car, then i dread to think what damage they can do to your car!

    Yep, they made a mistake, they'll ring, or rather the person who's going to a slap will, if they want their money.

    Personally I would be willing to pay the cost price of the part only, that way only the garage has suffered from it's employees incompetance. ;)

    Anyone can make a mistake, but this garage has made at least 2 (The first when they told you it was a FOC warranty repair, and the second when they put it in writing on their invoice).

    So stick to your guns and see who blinks first!

    Without knowing the make or model, there are enough recalls on cars now to expect work free of charge after the warranty expires.
