    No, laura - do NOT do this under any circumstances - It is up to Mackenzie Hall to prove any 'alleged debt' that they are chasing you for. You are entitled to ask them for proof, plus up to date statements. There are several ways to do this, and the first one is to send the 'prove-it' letter that I posted in my last post.
    You are, equally, entitled to ask for a copy of the original executed consumer credit agreement, and up to date statements by submitting a 'cca request'. This makes MH legally obliged to provide these details within 12 working days of your request, and without them, they can not pursue the account. There is, however, a statutory fee of £1, for this - further details can be seen, together with a template letter that you can send them, on the following link:

  • Thank you, I have just amended the "prove-it" letter and am going to the post office to send if recorded delivery today. I will wait and see what happens.

    There is absolutely no need to 'worry' when dealing with the ilk of Mackenzie Hall. You just need to know, and not be afraid to demand, your rights.
    MH are a particularily nasty form of pondlife that masquerades under the 'umbrella' of 'Debt Collection'.
    They 'specialise' in 'debts' which are, providing the debtor knows his rights' no longer 'enforceable through the courts - whether by the fact that they are 'statute barred' (over six years old) or the original 'paperwork' does not exist, or is flawed in such a way as to make the 'debt' unenforceable.
    They get away with 'plying their evil trade' purely due to the fact that the overwhelming majority of 'alleged debtors' are, in fact, totally unaware of the fact that the Law actually offers them a degree of protection against illegal agreements and unethical creditors.
    MH do this by 'frightening' their victims, usually with empty threats, into paying up before they become aware of any rights that they may have in law.
    MH are the pits.

  • Hi Guys.
    I'm new to this!
    My partner recieved a letter from Mackenzie Hall in Feb 08.
    They claim he owes over £2000 for an Abbey National Credit Card.
    We have a credit report & they are right. He does have this debt.
    However it was defaulted in June 2001.
    We contacted them to try & get more info on this debt. They basically said it's not their responsiblity to find out info on our debt.
    In July 08 we recieved a letter (again photocopied) from a company called Meritforce Door Step Collection Agents stating that MH have instructed them to collect this debt.
    My partner rang them straight away but they didn't seem that bothered.
    Can anyone enlighten me, are they the same company? Letters are very similar!
    Anyway we sent them both a letter from advice on here stating this debt has been defaulted for more than 6yrs etc & we do not acknowledge it etc.
    On reciept of this a very rude lady from MH called. She wanted £1 to provide info which we refused. She assured us she would chase up his debt & this would not be the end of it.
    We then recieved a letter from MH offering us a reduced settlement offer.
    We have ignored this.
    Should we keep sending them the same letter regarding no aknowledgement of this debt or do we ignore them?
    I also notice on the credit report next to the debt it says the 'date updated' is feb 02. What does this mean?

    If the 'debt' referred to was 'defaulted' in June 2001, then it is almost certainly 'Statute Barred' and no longer enforceable through the Courts.
    Basically, if a 'debtor' has made no payment towards, or written acknowledgement, of the 'debt' for a period of 6 years (five in Scotland) then that 'debt' would fall within the terms of the 'Limitation Act 1980', meaning that once the debtor informs the creditor, or dca, that he will no longer be paying the debt as it is 'Statute Barred' (the only reason he need give), then that debt can no longer be pursued through the courts and the creditor/dca should cease all attempts at collection.     Don't worry about 'Meritforce' - they are part of MacKenzie Hall and have, as doorstep collectors, about as much 'authority' as double glazing salesman:

  • I posted the "prove it" letter yesterday by recorded mail. Is it now just a case of waiting and see if I hear from them again? Im just worried that they are going to send someone/people around to my parents house?

    Yes, laura - just 'wait'. Don't worry about 'threats' to send people around. MH can NOT send in the Bailiffs - only a Court can do that - so, in the unlikely event that anyone did turn up at your parents' house, they would be there purely as 'doorstep collectors' and would have about the same power, in law, as a group of 'carol singers' - you/your parents would be under no obligation to talk with them, they would have no 'right of entry' whether peaceful or otherwise and they must leave immediately when asked:

    MH really are the bottom feeders of the DCA's. They all use the same scare tactics and "threatograms" note the use of the words
    we MAY take you to court
    this MAY result in baliffs being sent round
    we MAY send a doorstep collector round
    Once you see these companies for the scum they are their threats become empty.
    MH and others (eversheds and robinson way and co) were know at my old job (in a government dept) to "lie" about who they were on the phone to try to get peoples addresses/details. This was complained about at a higher level, but nothing seems to be done.

I have just received a call from them, which I did not answer and they subsequently left me a voicemail asking me to call them regarding the correspondence they received from me . I have been advised in previous posts not to call them but I dont want them harrassing me all the time - what should I do?
