    Well - finally you have admitted it.
    I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
    If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

  • So...just time for a little update.

    Following the advice on this forum I decided to do two things. Firstly I decided to put the £400 or so that MH had requested to settle the account onto my barclaycard (well...370 of it anyway) so now my credit card is zeroed. And secondly I decided to ignore any further correspondence from these jokers unless I received a genuine court document requesting the payment wherupon I could use the money sitting in the credit card to get out of jail free so to speak. And the result?.....

    I received a call from one of their advisors about a week later who asked me to confirm name address date of birth etc. I advised him that he had mmy name correct but refused to acknowledge any further information as I had been advised by a "legal advisor" not to. There was an immediate attack response to this with the threats running along to line of if you dont well go to court, send bailiffs, etc etc to which I said "carry on." He then started again at which point I took great delight in cutting him off mid flow and stated I was going to terminate the call. I heard him say "dont you hang up on us or we'll...." at which point the handset was down.

    Thats was about three weeks ago and nothing further has been sent and no more calls.

    Again....had I not seen this forum I would have happily paid this so once more....thanks to all who contribute here...another 400.00 not going into the pocket of these shyster swine!

    I had an interesting conversation with a debt collecting agent on behalf of one of my staff members. Once I had gone through all the usual " we need permission from the creditor before we can talk to you" stuff and the young lady who was next to me gave her premission, I asked the question " Do you now own this debt?" The guy on the other end proudly announced that he did.

    My response brought a deathly silence. " Oh good, it is you that I need to sue then as the agreement I have in front of me is unenforceable. You will be hearing from our solicitors who will be seeking redress from you now instead of the lender". I do not think he has contacted my staff member since nor expect him to.
    I am a former Broker, former IFA and former compliance officer, for my sins.

    However, I have since seen the light.

    It is not illegal to open another persons mail unless you intend to commit fraud - this is frequently incorrectly posted:)

  • I had similar letters from a different debt collecting agency demanding payment immediately for a £350 debt I had outstanding over 8 years ago! I wrote to them saying about the 'statute barred' and they then offered me a 'pay half' offer. this debt was with a CCJ after the original company twice took me to court demanding more than the £1 a month we could afford - at the time my late husband was in debt for over £8,000 and my little debt of just under £78 was lumped in with his for the CAB to help us. After my husband died, CAB wrote asking for it to be waived like all his debts were, they never replied so I assumed it was waivered, only to get this recent letter out of the blue. They did say that although they recognise the Limitations Act that it was a 'moral' duty for me to pay them! I disagree because they were the ones putting more and more on with interest, then court fees! I feel I did pay off what I owed in the first instance. I have thankfully, not received any more correspondence for over two months now and CAB have no record of it as they destroyed them after 6 years. My advice is to state to the company about the Limitations Act then ignore all further correspondence from them.

    This is a 'normal' response from this type of uncaring vulture. Since they know absolutely nothing about 'morals', they are hardly in any position to 'preach' about them. You have the Law on your side - they don't.

    This is standard DCA speak for "we do not have a cat in hell's chance of forcing you to pay up, so we will try the psychological tack instead".

    If they come back to you again report them to the OFT, Trading Standards and all. Once you sent the statute bard letter, pursuing you is haressment

  • A year ago I received a letter from Mackenzie Hall - they asked me to contact them - Having finally cleared all my debt 2 years ago (some were partial settlements but agreed with the companies as a full and final settlement). They were looking for me in my previous married name (which I have not used in 9 years).

    I contacted them and very firmly told them that the person they were looking for did not live at the address any longer and to stop sending letters - all further mail from them I marked as RTS Not at this Address. I heard nothing, until last week another letter came from Mackenzie Hall. In addition to this my neighbours door was knocked and the lady said she was trying to find me, and asked him would he please pass a message onto me - which he wrote down personally and put through my letterbox - I cant believe that a company would do this!!

    I had no idea who this was, so I phoned the number and I told them that the person they were looking for did not live at the address, that they had done so previously but had left a year ago.

    I cant believe these people are contacting my neighbours now - how do I stop them????

    I have never admitted to anything, have never said who I was or that I lived here - but I dont want them knocking my door or anyone elses who lives near me - does anyone know how I stop them??
