    Irrespective of whatever act you wish to quote... you bought a product. Its fit for purpose and working. You have no legal right to refund.

    It wasn't mis-sold as you asked if it worked where you lived and they did not give a clear answer - they never guaranteed it would work where you live.

    I'm happy that Best Buy have the balls to charge a restocking fee... everyone expects a no-quibble returns policy, but none of those people are wishing to buy the returned stock at full price forcing the store to discount the product... this money doesn't come from nowhere, so the store has to raise their prices to pay for those people who are too lazy to research their products before hand.

    You have used the wrong section of the act ...go and read it properly and understand it. And then answer the whole of my post completely including obligations under common law!!!!

    If you know and are so sure exactly what you're entitled to, then please educate the rest of us by highlighting and explaining them.

    oooook, I checked this post a couple of days and look where it's got to! A good ol' slagging match.. just what I like! :D

    Anyway after having consulted the oracle that is google.. I've found out about this "restocking fee"

    From best buy's site:
    If the product’s not in fully resaleable condition we reserve the right to refuse a refund or retain up to 15% of the original selling price to cover the costs that we incur in repackaging and restocking.

    Be very careful if you're thinking of returning your products to Best Buy, if the manual, accessories or even the box or packaging is damaged in any way, then the store reserves the right to exercise their 15% restocking fee which they will not shrink from doing. If the bought item is not returned in a condition that they can resell instantly, then they take off 15% of your refund to pay for repackaging and re-shelving the item. Does it cost 15% to get a new manual or box? Probably not, but the idea is to put people off trying to pull a fast one or really taking the mickey by bringing products back after deciding that they don't want them any more. You're also only given 14 days to do so in many cases.

    So was the aerial returned in a condition that would allow them to resell it?

  • Thank you for this positive post!!!! The Aerial was carefully re-packed and packaged ready for re-sale. I posted on here to warn others about this "restocking fee" Watch out for this!!! It will spread unless we all make a stand and stop the Americanisation of our goods and services. Fight for your rights or lose them!!! Use the Sale Of Goods Act and learn about the other consumer protection acts too. And enforce your rights every time. Say "no to Bestbuy" every time they try to "steal" 15% of your hard earned from you.
    Also learn the Unfair Contract Act. You will find they cannot rely on enforcing this fee unless they bring your attention to it before the sale. Then you have the choice to hit them where it hurts by buying elsewhere. If we all do this then this practice will be wiped out....until they dream up a new ruse that is.

    As for being happy they have the balls to charge a restocking fee well all i can say is there is always one, and they always turn out to be a collaborator, a sycophantic employee. Or just plain mentally ill!!!!

    If you look at his posts on other threads he has difficulty answering straight forward questions so don't hold your breath.

    You don't seem very keen to expand upon or explain how the unfair Contract Terms Act applies.

    They're not roping you into a contract that excludes them from liability for anything.

    If they had formed a contract that said that you cannot return items bought for any reason at all, perhaps you'd have a case, but you're trying to return something which may not be faulty (you haven't answered any of my questions about the product yet).

    Anybody would think that you were the troll, throwing around legislature without any explanation and just shouting "YOU'RE WRONG" at anybody who doesn't immediately agree with you. I'm eager to learn, if you're willing to teach.
