Failed ESA Medical and PHI Payments

    atos were told to give me a medical for dla recently, after 6 weeks i got a letter at 2pm on a tuesday for a medical at 9am on the thursday, i phoned immediatly to rebook it as i was off on holiday that date, the lady on the phone told me they would contact me with another appointment for next week, 6 weeks later i spoke to dla who told me the report atos sent them stated that i had cancelled 2 appointments!! ATOS are liars and incompetant, due to there lies my dla was reassesed incorrectly and they have removed the mobility component and dropped the care to the lowest rate, i have had no payments for 3 months due to there incompetance, if i had a motability car of a car on finance with my dla i would have lost it by now!

    After reading the terrible stuff about ATOS on here and another sites, I'm lucky enough to be in a position (with the PHI payments) to give the medical a miss and not claim ESA anymore. I can't bring myself to go though all the stress etc. It's bad enough basically being forced to stay off work without having more problems adding up and making me even more ill !

    I can't read the small print on my companies insurance policy as they will only let me have access to the standard one all employees receive.
    ATOS do reports for employers. They have contracts for these things.

    I'm taking it that that is why ATOS got in touch.

    An E/R can ask HMRC to arrange an ATOS medical for an employee. See page 10 of the E/Rs SSP guide-

    Thanks for that, I discussed a return to work with my GP, but as my employer had had me go for 5 previous Occ Health and 3 workstation assessment and still not got much done. He signed me off again.

    The OH reports were very much in my favour to work locally (office 10mins away) or at home, but the company didn't put any work my way and just isolated me as much as they could.

    I'd like to go back but have been told me my ergonomic desk and chair have been left in an old part of the building that is up for let!

    Basically they seem happy that I'm off and the PHI is paying me, as far as the company are concerned I'm not on their books.
