Failed ESA Medical and PHI Payments

I've been reading some of the threads on ESA on here and various other site, but I'm still slightly confused, so maybe someone can put me straight.

I've been off work term-term sick and getting paid for 6 months. After that PHI payments kick in, but they deduct ESA payments which I have started to claim.

Now I've got an ATSO medical coming, which I reckon I'll fail reading about it.

Now if I do fail the medical, I am correct that the DWP will write to my GP telling them to stop writing any sick notes?

    The DWP will issue a letter saying sicklines are no longer required for state benefit purposes. Just state to your doctor that you require them for your provider. They should still give them.

    Agreed, although the GP may charge for them.

    They dont ever charge for them in northern Ireland.

    Issuing a med cert for non state benefit purposes is a private service. Therefore the GP has the right to charge for them, should they wish to do so. It does not matter where you are in the UK.

    My GP has never charged and I've only just started on the ESA, sending a photocopy to my employer.

    I guess I'll end up losing the ESA payments, but will the PHI company carry on paying someone that has failed an ATSO medical?

    That is something you will need to ask your insurer.

    BTW it is ATOS, not ATSO.

    So the person says.

    If they employer contracted ATOS it would be their job to provide a report.

    Seems strange that an employer would get access to an ATOS report anyway.

    I can't read the small print on my companies insurance policy as they will only let me have access to the standard one all employees receive.
