    I dont think thats Capital One directly, thats a Birmingham code number and their offices are in Nottingham which is 0115.

    It sounds to me like its been sold to an outside DCA.

    Your lucky really, I got calls from an Indian call centre I couldnt understand them at all I asked them to put it in writing but heard nothing back!.

    OP, head over to the Debt Free Wannabee (DFW) board. You will find a lot of information and help from people there. They should also be able to point you towards some template letters.

    DCA's are know for their harrassing ways, but communication is key. In writing only! Otherwise they'll say you agreed to give them 20,000 k over the phone when you may only have 20p!

    You'll also need to complete your SOA and send it into them as proof of your income and expenditure and how much you can afford to repay them each month.

I will send them a letter about it and I have offer then a £1 token payment, but they say I MUST pay the full amount or they will take me to a debt collecter. what should I do ........... keep paying them a £1 token payment??? if you can help that would be fab. thanks again

    From what I understand, you may actually be better off if the debt goes to a DCA (debt collection agency).

    They are NOT bailliffs and therefore have no right/power to enter your home, despite what they may say. Do NOT let them in (if they even bother to show up), and don't ever sign anything (they've been known to use the signatures to forge documents). If they show up, and refuse to leave, advise them they have X amount of time before you call the police.

    You could only give them what you have. So they can demand all they like, it doesn't matter.

    The DCA is more likely to accept a payment plan (although they will kick up a fuss to begin with) and are also known for accepting reduced full & final settlement payments as they buy the debt for much cheaper than what you owe.

    If all else fails, and they try to take you to court, they will most likely still lose out because the judge will assess your statement of affairs (SOA) and quite often sets the repayment rate at either what you have stated you can afford, or, sometimes they even set it lower. But it is very rare for a DCA to take it that far unless it is a very substantial debt.

    For now, keep paying the 1 GBP token payment on the same date every month. This will, at the very least, display that you are sticking to a plan. If they threaten to send it to a DCA again, just tell them to go ahead!

    NID isn't usually nasty. Actually, OP, NID (never-in-doubt) has quite a lot of info about all this and may be able to help you a lot more. He's usually around the DFW board quite often, or you can send him a PM.

    Someone calling himself* ANDREWHORNBY joined the forum and started making some random personal posts. I suspect that it was a regular poster using a pseudonym to vent his* frustrations.



    *I say himself and his because I don't think that a member of the fairer sex would do that.
