Consumer rights

Hi,

I luv my new Notebook and free extras. (bag excepted)

The only niggle is the FREE laptop bag n mouse 508/2975 is v.rare! Argos said I have no rights if this item never comes in, not even a substitute. The receipt is valid for 2 months.

You would have thought they would marry the stock positions up!!!!

It was listed in the home, instore cats, confirmed by telephone as wasn't on the Argos website and HotUK seems to think expired!!

What are my rights???

    ok,

A shop says you get a free added item to your purchase but it is currently unavailable, what are your rights to a free substitute if the item never becomes avail within a reasonable time??

It was listed as a WOW item!!

    It'll be 'subject to availability'

If I tell you who I work for, I'm not allowed to help you. If I don't say, then I can help you with questions and fixing products. Regardless, there's still no secret EU law.

    "inducement to purchase" !

"An advantage or benefit that precipitates a particular action on the part of an individual. In the law of contracts, the inducement is a pledge or promise that causes an individual to enter into a particular agreement. An inducement to purchase is something that encourages an individual to buy a particular item, such as the promise of a price reduction. Consideration is the inducement to a contract."

They have a right to the product, a substitute or they can demand a refund as the contract has not been fulfilled.

Surely the British Code of Advertising, Sales Promotion and Direct Marketing means they have to make some effort to provide an alternative? Complaining to the Advertising Standards Authority may not solve the problem for you, but may persuade Argos to take this more seriously in future.

Googling legal queries can actually be really, massively dangerous. Please only post if you really know the answer.

Spouting principles of American law really doesn't help OP.

Well to be fair, the OP didnt ask what her rights were under UK law :D More implied restriction than express.

IMO consumer law should be something the average joe can understand.......with the way things are now, a lot of it rests on the fine print which COULD be worded in laymens terms but is usually more complicated than it needs to be - i'm convinced this is purely to try and confuse a good % of their customers so their profits dont suffer from people enforcing their rights. Gone are the days you could trust a retailer to have the customers best interests at heart. Now it all seems to be how they can uhm (how to put this politely)....dupe the customer while increasing profits and revenues.

Personally I wouldn't care what the law states. If you was originally told that you will get a bag and then you don't, you go into Argos and tell them you want a substitute or a refund.
