    First and foremost the main aim of the Santander's DCA is to get back the money that is owed to them. To this end they will use all forms of scare tactics to force people into paying the debt back. This irresponsible approach just forces people into further debt and this is clearly highlighted in your case whereby they are wanting you to take out another loan. What a joke.

    They will threaten you with court action but in the unlikely event that they do which is highly unlikely 99.9% of judges will throw it out as long as you continue with your DMP payments. The majority of judges will take the view that you are paying what you can and by increasing your payment to them it will be seen as unfair by your other creditors. The result will be that they will throw it out of court.

    Santander subscribe to the lending code as will their DCA therefore the use of threatening language in correspondence it breaches the lending guide lines. Creditors must be sympathetic to people in financial hardship.

    STOP RINGING THE COMPANY write to them informing them that the amount you pay is all you can afford and that all further correspondence must go via CCCS who are your appointed DMP representatives and that you request they remove your telephone number from their records.

    Try not to worry you tackling your problem and Santander have to face up to that. The reality is that the banks are responsible for the majority of debt in the UK as they are quick to loan money with out carrying out proper financial checks which results in people not being able to pay their debts and even when they are facing up to them they offer more money where is the logic in that. Its about time the banks faced up to their responsibilities as we are trying to do on our DMPs.

    Just keep paying what you can, do not sign anything and contact CCCS and ask them to contact the DCA on your behalf. If they continue to harass you report them to the OFT.
