    Do not give in that is what they want you to do. Creditors a breaking the law but continue to do this because they know people are ignorant to the fact that it is against the law.

    They are breaching Section 40 Administration of Justice Act see the link below for full details. I wrote to my creditors and told them to remove my telephone number from their records and to correspond with me in writing and that they should be dealing with my appointed advisors who have full authority to act on my behalf.

    I know its worrying in the beginning but things do get better and I am speaking from experience. Good Luck and do not give in stay strong.

    Can anyone assist me on this matter.

    I had an overdraft facility with Barclays which they closed when my DMP started some 8 months ago I received a letter stating the balance of the account in May 2010. I have paid via CCCS my monthly payment but have never received a statement. I recall reading somewhere that banks have to send you statements at least every 6 months has anyone received statements for their overdrafts? I am considering writing requesting a statement but would like to know what my rights are. I am not sure if they accepted my payment and I want to know the position of my account.

    Any advice is much appreciated.

  • Thanks Mikon - I know I'm doing the right thing by going on the DMP.

    I'll write to the creditors who are phoning work - let's hope they stop soon!

  • If you are able to afford it pay the HSBC, cancel every other DD & once your DMP is set up then contact HSBC & advise of your situation? I would suggest you also withdraw the rest of your salary's out! This is what we did after being advised by CCCS. Hope that helps, I think the panic initially is around getting everything done in the right order, but sometimes it gets a bit tricky & I think that's what sets the panic in!!

  • well I have to say I am very happy right now! I have just spoken to Blair, Oliver and Scott after receiving their awful court letter and I have to say while I was dialing the number my heart was pounding!!!

    But you guys were right:D BOS have finally received and processed my OH letter of authority so I can deal with them, and, BOS confirmed that they have received the first payment from CCCS its been deducted from the amount we owe. And, they are more than happy!!:j:j:j

    I cant tell you how relieved I feel, you guys were sooooo right about how easy BOS are to deal with. I know that the CCCS told me never to ring them again, but I just had to know for myself that everything was ok.

    Thanks again to you guys for your advice, help and support. We've got along way to go, but I know that we will all get there together:D

    Ianmak thanks for responding to my request regarding Barclays Bank Overdraft Statement.


    Anyway contacted my Cable supplier today and informed them that I was leaving as SKY had made me an offer that was half the price I was paying at the moment. Cable asked me how much and then after a bit of haggling they reduced my existing monthly payment by £22.50 a saving of £270 per year cannot believe it but they have. They said that they have used my loyalty discount.

    I only rang up on spec as I had read on MSE forum of other people doing this so I thought I would give it try and it has worked.

    So another bit of money saved so I am looking at other things now.

    I'm going to answer one phone call from each company - explain that I am starting a DMP with CCCS - give them my ref number and then explain that I will only be responding to written correspondence from now on. After that I am going to ignore any phone calls from them. Does this seem right?

    I have to admit I felt quite sick doing the letters today, but I'm glad they are done and sent.

    Thats what i plan on doing, i think thats a good idea... i think there is also a template letter somone has posted somewhere that says something along those lines if they start calling you all the time... something about harassment and you will only respond to letters...?!

    I'm starting a DMP with the CCCS on 1st of Feb and i have set up a new bank account as i have a loan and overdraft with my current bank ( firstdirect)... do i need to have cancelled my firstdirect bank account before my DMP starts? Wages will not be going into that account anymore but could firstdirect still take money from it anyway for my loan repayment, (although i HAVE cancelled the direct debit,) making me overdrawn over my limit and then charging me for it?? Or do i not cancel any accounts and just let CCCS and creditors come to arrangements?
