    you would think so wouldn't you! - no rhyme or reason really - Nationwide are doing the same on the other CC we have..balance is 1k less yet they have a ccj awarded at £120 pcm - £35pcm more!:mad:

    I don't think there is? However you could post a new thread and there are a few regulars who are quite knowledgeable in that sort of thing and will normally respond?

    Hi Guys

    Decided to write to my creditors a few weeks ago asking them to stop the charges they were adding. I recived a letter yesterday from citifinancial saying they have sold my debt onto capquest is this good?

    Have made 3 payments now!!! keep going everyone we will be better off eventually!!!!!!!!!!!!!
  • Hi all!

    Well its Friday the postman has just delivered the mail and low and behold there are some threatening letters from our good friends at HSBC. I knew there would be some some DMP related mail before he even put it through the door, well it is Friday after all!

    The letters are final demands for a loan and after speaking with PP I am hoping after this last hurrah to be passed onto their in house debt collectors and fingers crossed not the courts route:eek:

    Anyone else had some heart warming mail this morning we probably all have its Friday!!!!!!!:D

  • I've had mail too...as you say surpisingingly delivered on a Friday....
  • We dont get the mail until i get home from work,

    But so far all correspondence has been good.

    Halifax online credit cards now say "Your account is subject to a payment plan" etc etc, and looking at the account no interest has been added.

    The JustABank site now shows all the balances and the first payment is due to PP on my birthday (17/11 if anyone wants to send me a e-card ;) ) and on a side note i still have some money in the bank rather than scraping round for shopping money!

    Sent the Mrs out at weekend to do some charity shop clothes shopping for herself and she had a ball. Came back all excited at what bargains she had found, and was gob-smacked at the sheer amount of clothes she found for the budget we had set. She cant wait for next months budget as she has not bought herself any clothes for over three years due to lack of funds.

  • Oh, yeah, forgot to add, just changed from NPower to Scottish Power so got £105 cashback to come and found out that the NPower account is £243 in credit so getting a cheque back for that!

    well! redetermination was interesting!
    Had a chat with Nationwides representative solicitor prior to seeing the judge - to be honest he was very transparent and explained the process very well - was also honest and outlined what he would be going for.

    judge was a bit dour but looking at things in the interest on fairness - he eventually found in our favour - Nationwide had already requested a forthwith judgement that had been refused and asked again for a charging order! - Judge refused this and set a review of 12 months and discharged the payments by monthly installments at what we had been paying for the last 13 months via payplan.

    All in all it was a wee bit scary (although the oppositions solicitor did a lot to put us at ease! - he did fight hard but to be honest its his job) but you can see for the judge its a mundane process based on what he thinks is necessary to secure continued payments.

    Got to do it all again on Tuesday for another CC in my name again from Nationwide - be interesting to see what the outcome is!

    gonna have fish and chips and beer as a relief treat...for now:rotfl:

    It will not be too long before you are excited for the post to see the balance coming down.

    Chilli - you've done well with Halifax they rarely respond to anything. Perhaps they have a soft spot for passionate Scorpios! Glad to hear you have been treating the Mrs, you old romantic! Great news on the cheque back too, a wee treat and something for the rainy day fund perhaps?

    Grant I would have been pooping myself but it sounds as though you did well. Hope your news is encouraging for others so thanks for posting. Let us know how you get on Tuesday.

    Grant I'm so glad it went well for you in court. Hopefully the voice of reason will continue next week for you.

    Can I ask if anyone knows. What if a ccj hearing orders a higher repayment amount than you are paying? I presume that the only way to avoid a charging order would be to pay the increased amount but that would predjudice other creditors? So I guess you'd have to take the charging order or come off the DMP?
    Does any of that make sense and if so can anyone answer it!!
