They have access, it doesn't mean they can use it.
Example, if you go for a job interview, you have to sign a declaration that you give permission for them to perform a CRB check. You have to give prior consent.
Anyway, I very much doubt US immigration have instant access either way, so they would be none the wiser.0 -
The big point you are missing - NOT UK law = US and if you don't give permission, Gues What - They won't let you in!!! And they have your name/passport number etc from your application so they "flag" you!

But, as my crime isn't of moral terpitude, I don't have anything to worry about.
My point being, my friend who was wrongly convicted of armed robbery has to apply from a Visa using his own time and money, because he was arrested of a crime of this kind. He was proven to be innocent, yet because the US stipluates these stupid rules, he still has to apply for one.
Why do you dare me to give you my name? Is that some kind of threat? What would you succeed?
US immigration will not have access to my criminal record, they have no reason to try and obtain it, and if they did, there is argument that I have honestly answered the question on ESTA.
You also are mentioning that if I cant take the pupnishment then don't do the crime. I did the punishment thankyou. I was slapped with community service, later reduced. That was my punishment. The magistrates mentioned nothing about messing about with Visa's.

OK - I gave my opinion only to point out where you will find out the truth, not rumour, gossip or incorect thoughts from people who don't know.
Say you who beleives
a) you can answer no to moral turpitude if you were arrested but NOT convicted,Arrest is NOT a conviction .......
If the question states "Have you ever been arrested?" that is different, and in that case you must admit to arrest but that probably will just make the OHS look a little deeper and get the info from the UK Police.
You don't have the foggiest what the question is on ESTA do you. You dodge that question as it proves you don't know it asks about arrests as well as convictions.
and doesn't have a clue what information is used in determining why the ESTA is approved or notAnd the fact that he has been approved for his ESTA proves my point - although they ask it does not exclude you from US entry as - Guess What? - no charges mean he is innocent!
As I said - They'll check a little further but no conviction = no offence.
You seem to beleive that ESTA checks ALL convictions and arrests at that point against a list of CiMTs. If you answered YES to that question you are refused at that point, if you answer NO except in specific instances) you aren't.
b) beleives the consulate gives out telephone advice
c) beleives that that advice is legally binding on the USit needs to be asked to the people that will/will not allow him into the USA - exactly why I refered him to ESTA site an Embassy site a few posts ago!
Consulate won't give out telephone advice, they state you must get a visa, even their website states that. Consulate advice is also not legally binding on the US.

I studied Law at Kings College London Law School - so as FH Brit might suggest, I am British and my law degree is a UK qualification ! ! !
Why you wasting this top law qualification (we in UK have kindly paid for you to get) by becoming a debt collector in Florida and spending work time pontificating about things you know little about on the net?
(To say nothing of you returning to threads you told us you'd left for ever, then insisting on answering questions after blasphemously telling us you won't do it anymore)
