Surely not on every aspect of the MOT? I expect I'm talking extreme cases here, but It would be nice to know that I'm not liable for more hidden MOT failures (in the event of a police stop) when in a rental car.

There is no way you could be prosecuted for, I dunno, a dangerously worn suspension component. This would fall to the hirer as it's beyond the remit of the driver to check this.

Not liable for out of date road tax, the registered keeper is!

I believe that "failure to display a current tax disc" is actually a fixed penalty to the driver, whilst failure to renew tax or declare SORN is the responsibility of the keeper, actually.

Which neatly brings us back to the OP ;)

Its one of those stupid rules. If you hire a car and its not roadworthy its your fault.

Nothing you can do about it, Either take it or dont, But if you get stopped its all
    down to you.

    Technically you're right ;)

The chances of getting a FPN are pretty slim though since the widespread adoption of ANPR! If caught with this system the DVLA issues the penalty to the registered keeper.

Traffic wardens can also report failure to display but, again, this goes to the DVLA.

To be given a FPN in the OPs circumstances (or hire car) would need an officer with a serious chip on his shoulder &/or power complex :)

    But yes, you are right.

Ah well that narrows it down to being safe with only 2% of the police force then.

I wouldn't try and fit a gas cooker either but if I smelt gas I'd turn it off at the mains. Then call a plumber.

I'd have a cigarette first to calm down then call a plumber.

My brother picked up a loaded 40ft trailer at the docks, checked it over and checked the load was secure. As he braked approaching a roundabout the trailer snapped in half. He was the one who ended up in court because he was in charge of the unroadworthy trailer. Luckily his company supplied a good solicitor and the judge agreed it was not his fault as he could not have forseen this happening especially as the trailer had recently been tested but it still went as far as prosecuting him.
