    Did they have the measurements for the item of clothing on the listing? Not all makes are the same, so if you didn't ask, then I can't see how the seller should be liable to refund.

    Possibly if something's described relatively loosely, 12 ~ 14, say, then you takes your chances. But two whole sizes is a considerable difference. If I got a size 10 instead of a 14, I'd be jiggered, as was the OP.

    I'd certainly expect a refund if the label size was different to the advertised sizem regardless of measurements. If I buy something with a label size that has my size on it, and it doesn't fit, I just have to put up with it, as different makes are not all the same, as you rightly point out.
    I ave a dodgy H, so sometimes I will sound dead common, on occasion dead stupid and rarely, pig ignorant. Sometimes I may be these things, but I will always blame it on my dodgy H.

    Sorry, I'm a bit of a grumble weed today, no offence intended ... well it might be, but I'll be sorry.

    Did you pay by a credit card? Try talking to them, who may chargeback the transaction. They are a business seller, report them to trading standards/consumer direct for failing to abide by the DSR's. Even if it was as described, within 7 days you have a right to a full refund once you post it.

    The voucher is a result. As for the dispute, I suppose it is like PP, in that when the tracking shows as delivered/refused then you will be refunded. Just make sure you have the tracking ref attached to the dispute. As soon as anything shows, get on the phone to Ebay. If you got them to sort it in 17 mins last time, you obviously have the midas touch. :D

    This is Ebay and Paypal. You don't NEED DSR. They have their own rules which are easier and free.

    45 days to return anything to any seller, for whatever reason, in whatever state.* Why waste that option and go for CC - (who invariably state as a third party payment option, they will not act) or DSR?

    Faulty goods have to be returned even under DSRs. Only fake goods can be retained as long as they are destroyed.

    WHO may not require you?

    As a business seller I don't always require a buyer to send something back if faulty/damaged, but I make that decision, it is not based on an legislation - or lack of it.

    Firstly, most credit card companies do not involve themselves in acting for you when you use a third party payment method like Paypal. Some do, such as HSBC and FD, I have heard success stories on both. There may be more, but I only speak of FACTS I am a party to.

    However, from where does your info come, that they do not require the item back?

    It was tight fitting motorbike leathers for my OH!! ;)

    The advert stated the brand (a well known one), but instead of the seller writing the brand size (which was the ONLY size written inside the leathers - they don't use UK sizes) he'd written (guessed??) the UK size, and got it wrong!

    It's a shame really, as they were in perfect condition, but alas only suitable for a very skinny bloke, so only worth a fraction of the price.

    I'll phone ebay the second they're showing as delivered, and make sure the refund goes through, as the seller has no intention of refunding until July, so no point relying on him to do it!
