Are 3 correct?

I signed up to a new contract with three.co.uk on thursday last week. Like most they offer free next day delivery.
As i ordered it after cut off on thursday, friday would be 'dispatch day' and it should arrive monday 7th. (today).
After waiting in all day, the cut off of 5.30 for delivery passes. Before I called three I checked my email, and hey presto an email from three at 3pm today (proposed delivery date) detailing that the phone has been sent and will be with me on Monday 7th June.

On ordering, I was given a drop down to choose a delivery date, hence expecting it as promised and taking a days annual leave to wait in for it.

On calling 3, their approach was, well you were sent an email @ 3pm today saying it has been dispatched (due to a stock issue apparently), how could I expect delivery today!?

The fact remains that I chose a delivery date, three should have dispatched the phone on friday for delivery on monday. NOT dispatch on Monday, send the original email claiming delivery for Monday that obviously wont be met, then deliver tuesday.

I pushed for some sort of compensation and she basically laughed at me. Surely there has been a contract made to deliver as stated, and if they were unable to for whatever reason, I should have been told?

The phone rep had a serious attitude problem to begin with, so pushing and pushing was getting me no where. Do you think I should complain formally for some compensation, even a months free line rental. Personally I see the delivery date as a confirmed contracted date, and taking annual leave and effectivly wasting it has not made me a happy sailor!

What are your thoughts?
Thanks.

why didnt you just go to a 3store at the weekend and do the deal there, walk away with the phone, better after sales, no lost holiday

    Simples!
  • There was no indication on the site at any time that there was a stock issue, and continued to let me choose a delivery time. I bought it online as you also get a £20 Accessory voucher for free.

Think of it this way, if you bought a bed for example from argos and they agreed a delivery date, you stayed in and it didnt turn, you wouldnt be too happy.

I cant understand why you say such a thing cause the op was clearly stitched up by 3 imagine if it was you having taken the whole day of only to findout you sat for nothing am sure you would be upset as well unless you work for them. Op yes matey you should have pressed them for some good will gesture. Phone up again and kick of.

3 stitched me up. Offered me the new Mifi not to leave. Sent a basic single in the post. I sent it back and they sent no Mifi and no dongle saying they couldn't do the deal. So I cancelled. They offered me an iPhone contract to try and keep me. Probably would send a gash samsung in the post or something instead. They really are appalling. Steer clear of them regardless of how cheap they are.
