This is the sort of thing that I would make a careful note of, file it away, don't make a fuss at the time but when you eventually leave tot up the value of any unlawful deductions from your salary (for that is what they are if you did not agree to them or indeed if you felt under pressure to agree to them at the time)

Send them an invoice, headed Formal Grievance, advising that you want the unlawful deductions returned to you in full within 7 days or you will file for an Employment Tribunal to recover the sum for you.

This is a vengeance is best served cold situation :)

I assume that you are not the only person ever to have been late.

    What are your colleague's views?

absolutely not - the thing that gets me is that there are a few who are late on a regular basis, and they get exactly the same "punishment". Being late does have an effect on the others here, I appreciate that, which is why I emailed immediately offering to make up the time, with an explanation of why I was late.

There wsa a similar incident when the snow hit us earlier in the year - the company decided to shut the office despite my colleagues and I being happy to stay, but then insisted it either come out of our holiday entitlement or be taken as unpaid emergency leave - despite the fact that the decision to close was against what 90% of us wanted to do!

Make sure from now on you don't "end up" staying beyond your finish time.

Do they have Atomic clocks at your work place and do you have to sychronise watches before going home?

This is the sort of nonsense that makes my blood boil. As a Union rep, if I couldn't sort it out informally, I would advise my member to put in a grievance then I would go in with them and ask everyone to tell me the time showing on their watches, mobile phones and wall clock. When they don't match I would then point out that managements actions were unreasonable as nobody watches, clocks etc show the same time all the time.

I would also advise the member to work those 15 minutes and then either apply for payment of them or 15 minutes of time given off.

If its important enough for the managers to make you feel small about its important enough to question.

Thank you very much :) it is ridiculous - our wall clock doesn't match our phone clock, which also doesn't match our PC clock - they say you are to go by your phone clock, but if that phone clock is, say, 2 minutes ahead of everything else, then you end up being "late" when you're actually on time!

The other thing that makes me laugh, is that they do have flexi sheets - they just don't tell the staff that they exist. My partner, who is a senior in another dept, says they haven't shown them to the new starters for at least 2 years. Our shift report tracker also shows what time is owed to us, and what time we owe them - they expect me to make up this 15 minutes, and yet if i ask to take off the 12.8 hours owed to me in lieu, I get laughed out of the office!

Ah! More info. I would not entertain a request to work 15 minutes over if I was already up by 12.8 hours. Blood yickling nonsense

Well you have two realistic options. One is to play them at at their own game (as suggested by others) and bend the rules to suit you, eg going on "after call" two mins before home time so you have less chance of staying late. I am sure you can think of other ways. Why not look for another job as well. Don't listen to the naysayers and the begrudgers who say there aren't any. There are, they just take a little bit of hunting for

Or you could raise a grievance about the issue and waste their time as well. If you are interested the Union that usually covers call centres and outsourcing is the CWU. The Union hate a lot of these call centers because of the way staff are treated.

    Good luck

I think the most sensible option is to look for something else - being a temp, i don't want to end up unemployed! Saying that, I hate how people are feeling so trapped - I think the company are really making the most of it and just relying on the fact that some of us are happy to have a job at all.
But I will certainly discuss with my agency, and make them aware. After all, they aren't getting paid for me doing extra time either!

I am certainly going to get a copy of all the extra minutes I've got though - they can add it to all the holiday pay I'm owed when I leave, seeing as they will never authorize holiday either :)

    Thanks very much!

I'm amazed that anyone would report themselves as being late, for the sake of one minute, on such an intangible measurement tool.

But setting that aside, assuming that you have indeed signed up to this clause (which would be worth checking) you do seem to have a problem of your own making. I think they call it shooting yourself in the foot!

Ten out of ten for honesty though.
  • I had a disaplinary recently for not working my contracted hours (38 worked 39 contracted), i got paid for 38, and in the disaplinary I mentioned that I have been writing down all the free overtime that I have given them, which at the time was almost a fortnight (yes a fortnight), and refused the warning.
