I have asked on another forum but am a little confused about what exactly to do next.
My auntie lost her husband last week and he had 2 credit cards each with £1000 outstanding on them.
They were in his name only but the house was in joint names. Now, she has spoken to the CC Companies and they have told her she will have to pay the outstanding money owed, which I said I didnt think was right, hence the question,
Can anyone tell me the legal positon of this and also what to write to these cc companies as a reply to their requests

I'm no expert but I believe it will have to be paid out of his estate. So if he has any insurance policies, pensions, etc. Then creditors will look for settlement from these.0

I also think it will be paid out of the estate after funeral expenses are taken, assuming there is anything left.

I'm sorry for your loss, however, I'm afraid I have to agree that they will be paid out of the estate. If there is no money in the estate (highly unlikely) then the outstanding amounts would be written off, i.e. they couldn't come after your aunt.
