Hi-I have foolishly agreed a payment plan with regal credit but they have taken £75 twice from my debit card. What can I do to get my money back?

    hi jubaxt,
I dont think it was foolish to agree a payment plan with them. You need to do that with anyone you owe money to (I take it you did owe them money, and they wern't just trying it on?).
You should contact regal credit - if you have an agreement with them they shouldnt have a problem with refunding the money. At the same time go to your bank and speak to them. They might be able to reverse the second payment.

My advice when dealing with Regal Credit is to get CAB to help you out. Their debt advisors are excellent at dealing with these idiots.

They did this before, where regal suddenly "created" an extra debt to NatWest, using an out of date balance.
They are either staggeringly incompetent or thoroughly dishonest.

If incompetent, they are evidently maintaining an inaccurate database, which is an offence under the Data Protection Act. You could make a complaint to ICO.

Can I complain to someone? because Im sure this is illegal them sending threatning letters like this to someone (me) who the debt has nothing to do with.
    Police, Trading Standards.
I need them to realise its not me they want!
Don't be surprised if they know that perfectly well.

I'm not sure if they come under the Banking Ombudsman or not. Check the letter to see which agency they are accredited with and write to them

The Banking Ombudsman was superseded by the Financial Ombudsman Service some years ago and it now DOES cover this.

What you need to do is specify which of the OFT guidance (effectively rules) they have breached and demand compensation for "Distress and Inconvenience".

The links to the OFT guidance and a template letter I prepared are on this thread.

When you send the template letter, get proof of posting from the Post Office (free). The Financial Ombudsman Service will assume the DCA received it two working days later.

Thanks guys, I have sent another letter off to them using the template one. If I receive another letter from them demanding payment, I'll take it further.

Well I hadn't heard from them for about 2 weeks after sending them the last letter. I thought maybe they finally got the message, but today I recieved another letter from them saying that despite sending letters to me and attempts to make contact they are going to recommend to their client that legal action is considered etc etc etc!

So thats it, I'm taking it to the financial ombudsman.

This is so much like the private parking debt collectors, they generally say "Final Notice, --Final ,Final Notice-- Really we mean it this time Final Notice. Then they give up.

With debt collectors its up to them to prove you owe the debt.

If you look on the "debt free wannabe" thread theres template letters and great advice on how to deal/cope with them :)
