Did all of the injured people report their concerns to Management of the hotel?
Being the Devils Advocate, I am thinking that what if the people who were in a position to rectify the situation were unaware of the hazardous surface?
You stated "they knew" but who actually knew?
Everybody was complaining and all made official complaints through the rep.
When my mum fell, 2 of the hotel staff were standing next to her laughing, i made them aware of the patch immediately.
The hotel staff knew.
And the hazardous surface was all around the pool with protective matting around the edge. It was near a dolphin statue fountain that everyone fell which is where there was no matting.0 -
OP - I'm a personal injury lawyer.
I'm not going to go into whether you may or may not have a case, that isn't an issue for a forum but one for a district judge. You asked who you should go to to make a claim.
I would advise you not to approach one of the claim's management companies that advertise on TV or tout for business in the shopping mall. Approach a firm of solicitors direct, most will give you an initial consultation free either in person or over the phone.
To find a recommended firm in your area I normally suggest people consult this website

It is an independant guide to the top firms in their field. Choose your geographic area then click "insurance" followed by "personal injury and clinical negligence - claimant" and see which firms are recommended. Call the top two or three in your local town and see whether they can help you.
You won't go far wrong with any of the recommended firms on there although the fact that the accident occured abroad does complicate matters slightly, in light of that if you struggle to find a firm that will deal with it try Irwin Mitchell. I don't work for them and have no connection with them but know that they have a department dedicated to travel/holiday claims so may be more willing to take the claim on than most.

Provided the rep backs up your story, it compounds my view that claiming against the travel company may be your best option but as I alluded to earlier, it will cost you nothing to see a NWNF solicitor and see what advice is forthcoming.0 -

The discussion above relates to English Law, and there is a potential claim in English Law. Matters of Jurisdiction are not straight forward, the OP didn't ask for legal advice and I don't consider that a forum is an appropriate place to provide it. Whichever jurisdiction the case is brought under it is for the judge to consider whether the claim should succeed.
The OP asked where she should go for advice and representation, I suggested a place she could get independant recommendations - what is your problem??
I haven't touted for business - I couldn't if I wanted to I don't deal with claimants anymore! And I haven't provided inappropriate advice like some of the posters above. As I have no idea where the OP is from I don't even know which firms will come up on the search I suggested she try!0 -

My problem is with personal injury lawyers and the companies they work for. Ouch - just banged my finger on my keyboard - now, where can I claim?And I haven't provided inappropriate advice like some of the posters above.
Would that be someone suggesting going to a NO WIN NO FEE solicitor as opposed to an independant one? I take it then you never worked for a NWNF company?
I make no apologies for my dislike for PI lawyers and please do not take it personal, but these people used to make my job bl**dy difficult by encouraging people to claim for trivial injuries that took budgets away from me when attempting to prevent major ones.0 -

No I was referring to the people purporting to offer advice on the prospects of success, when clearly they didn't have sufficient information to do so and some of them didn't even understand the law.

Not me, you don't know what my precise role is, but I suspect that we would be on the same side professionally! There is no need for this level of aggression. I simply pointed out to the OP where she can find details of highly recommended firms of solicitors who will give her good independent advice, which in my experience is a little more reliable than phoning up a claims management company who advertise on the TV and are only interested in selling insurance and getting referral fees.0
