Ebay advice regarding paypal claim

Basically ordered an item but was sent something different. I tried direct contact with the seller to rectify it (similiarly named cd's, figured it may be an honest mistake). It took days to get any reply and then the seller was not interested, on the advice of a regular ebay user I opened a paypal dispute.
Suddenly the guy is offering a refund if I return the item, but still claiming I got what I ordered. It was a 2cd with the full track listing on the ebay listing and I got a single cd album with different tracks so how he tries to claim that I dont know.
Anyway, I send the item recorded delivery (informing the seller of this), it takes ages to arrive (stupid royal mail :mad:). I called royal mail yesterday and they confirmed it had been delivered and stated they would email a copy of the signature to me, which they havent. I informed the seller of this on paypal and asked them to send the refund before the dispute was due to close or I will have to escalate it (I dont trust the guy to give me the refund after).

Now my dilemma, I only got the delivery confirmation yesterday (may have been delivered tuesday, royal mail didnt know :mad:). The dispute is due to close tomorrow morning at 8am, I would need to escalate it tonight as I wont have chance in the morning. What should I do? I havent heard anything back from the guy since he offered the refund if I sent the item back. Is this too short a time to expect a refund? If I leave it will I lose out on both the cd I sent back and my money? Please help!

  • What was the sellers feedback like? A good seller should be checking emails every day so i would expect a refund asap. Disputes are open for a week aren't they? Can you not contact paypal dispute again or add this information to the dispute already?

    20 days and then the dispute is closed unless escalated, no extensions given. And the seller has recently had some negative from another buyer that was sent wrong item. Sounded like seller was dragging feet about refund there too. Plus no responses when I've added updates on the dispute.

  • 20 days??? What a nightmare, obviously not interested at all. I would escalate the issue or are you prepared to forget about it? Depends what you spent really. If you haven't already i would report this seller to ebay.

    My issue is the item only arrived yesterday so I wouldnt expect a refund before, although that has given them nearly two days to give a refund...

  • Hmmm true, forgot about that detail (sorry). What do paypal say? Any advice from them seeing as though item only arrived back to seller 2 days ago.

    Not sought advice from them, been too busy with a new job. I could afford to lose the money, but its kinda got to a thing about principle now as the guy has just shown no interest in putting in effort for his mistake.

    Escalate to a claim, don't let the seller get away with it. If he refunds he can stop the chargeback anyway.

    Incidentally, if you sent it recorded you can see it tracke donline just go to http://www.royalmail.com/portal/rm and that will show the date it was delivered. However I note you have asked for a signature, if it went recorded that should cost you £2.50 and you don't really need it at this stage as paypal look at the online tracking first.

    I didnt actually ask for the signature, the woman said she would send it to me via email and took my email address. I looked again today and the item was not updated on the royal mail website. Seems strange, and Ive had no email from them. Did escalate the claim anyway.

    I'm confused then, what is it actualy showing on the RM web site. Is it delivered or not?

    It doesn't matter what you were told on the phone, what matters is what the track and trace online shows should anyone else look. If it is showing as delivered then you have all the proof you need for a paypal chargeback. If it isn't showing as delivered then it hasn't been, and you will lose a chargeback *but* can claim for loss by the Royal Mail.

    The signatures take a day or two to be uploaded - have a peek on RMs site again to check for an ePOD (theres a link below the status after you enter the tracking number to see a scan of the delivery slip when its available).
