    Quick update. Received bank statement today and lo and behold, since the ex started working 7 weeks ago, he has made 2 small payments into my bank account. I have no idea how reflective these payments might be of his current salary (they are very small - less than my meagre budget for the weekly shop), but I guess something is better than nothing. Phoned CSA to tell them payments had been made to get it noted on the system. Woman I spoke with laughed and said 'ah yes, that old chestnut, you tell them there's a liablity order on the way so they make a couple of payments in the hope a judge will be sympathetic....'.

    Notice that a Liability Order was being sought sent to ex at beginning of November. This has not (predictably) prompted him into contacting them, nor has he asked for the Order hearing to be heard closer to home. Was told to expect an update no earlier than the end of January.

    some NRPs just don't respond to anything! My ex ignored all liability order requests, and failed to attend court when summonsed a few times. When they arrested him he soon realised that actually acknowledging them was a good idea - the penny dropped when he was told he was being sent down in 2 weeks' time if no payment was received - funny, he paid up!
  • Hi - I have read this thread with much interest.
    Until 5years ago my ex and I had shared care of our daughter. Therefore, neither of us paid any money to the other.
    This then changed to him having her half of school hols and every other weekend.
    2 years ago I approached my ex to start contributing financially. He is self employed. I knew what 'salary' he was on, through an error by Royal Mail. I entered this into the CSA calculator. Told ex amount it said - but said if we could sort it amicably between us, we could look at 50% of that figure.
    World War 3 ensued
    He claims to CSA he is paid £140 a week. I therefore get approx £15 a week maintenance. Gosh.
    He drives a sports car. Lives in a mansion (compared to me!) has at least 5 holidays a year yadda yadda - you know the story.....
    I have appealed, completed variation orders etc, and now have a tribunal! May get me nowhere - but at least I can actually give my side!!
    CSA are so limited in their powers and have admitted to me time and time again, they have such huge backlogs.
    The final person at the CSA who looked at my case was really helpful.
    You really just have to keep on at them. I have called them once a week for nearly 2years. I was also told that as I was being paid 'something'.....that I was not being treated as a priority
    There are many NRPs out there who are responsible for their children and do not try to cheat the system. Unfortunatley, there are many more that are not and will lie and respond dishonestly in order to escape this responsibility.

    Just an update - spoken to the CSA today. Liability Order for £4k was granted earlier this week. Something, I guess.

    Ex has gone entirely AWOL. Appears to have moved in with the girlfriend but won't give me an address. Has been gone since before Xmas but hasn't let the CSA know. Caseworker said he could be prosecuted for that but the problem was, it's impossible to prosecute someone when you don't know where they are. We laughed. What else can you do?!

    Have contacted ex's solicitor to see if she's still acting for him. No response so far.

    As a result of ex's move, he is having children less. Have notified CSA verbally as he has to come down a category officially - she was happy to take this info from me. Said she would write to him at the address they have and let him know. If he doesn't respond then she will simply take my word for it. Handy, I think, at some level, to have an ex who won't communicate at all????!!!!!!

    Caseworker phoned. Liablity Order has been 'progressed' to the 'triage department' whereby it is assessed for actions which can be taken next. Caseworker, however, has also spoken with the legal department as she believes this is a case they will be interested in - reading between the lines, because the ex has a house, they should somehow be able to extract money from him and therefore it boosts their statistics so they'll pursue it more aggressively than someone they know has nothing. It's all politics, isn't it?!

    She noted that as ex has failed to give changes of address etc. which is criminal, the case will be better off in the legal department anyway as that can be chased from there.

    Told me to call in a couple of weeks to see where things were at as I should then get a response as to what is going to be done (or not).
  • It might be criminal not to give a change of address, but has there EVER been a prosecution due solely to that??

    eta I would be seriously wary of ongoing contact if you don't have an address for him.

    I know - the contact issue and no address. The kids are missing him dreadfully (he's not seen them since Xmas and is missing another weekend this weekend with them - his choice, no explaination given other than he's 'unavailable') so I don't want to be difficult but at the same time, it's a worry. No response from his solicitor. No contact with him whatsoever - can only assume he's up to something!

    oh and the criminal issue and the address - yes, apparently they have successfully prosecuted although rarely do because they need the address to prosecute and by the time they have it, it's just as easy to get on with the rest of it. Interesting.

    Right. Lost the will to live a bit with all of this but am trying to focus again.

    Spoke with CSA this week. No contact with ex since beginning of the year so phoned to say:
    a) he is now seeing the children less than 53 nights per year
    b) what are you doing?!

    Response to a) is now on file and they will be writing to both of us to confirm it. Assume he will kick off but hopefully he keeps his head in the sand 'cos at least that means he misses the opportunity to contest things. I am worried in that we have a court order which says he has them 2 nights a week. I have kept a record and have occassionally put in an e-mail to him stating 'since X date, you have not seen the children, nor asked to see them' just to try and cover myself. We'll see.
    b) is that they are in the middle of getting a Charging Order on his house which is likely to take another couple of months.

    They are still corresponding with him at his old address (I am not yet party to the new one). I made the point that he's moved. They said as they've had nothing from him to confirm that and no letters have been returned as 'not at this address' they can only assume he is receiving mail. So that's something.

    The interesting thing here is that they have totally bypassed the bailiff stage.

    Mm, not sure that their argument will stand - have they contact council tax dept to see if they can get a new address from them?

    Not that I'm aware of. Honestly - I have no real idea where he is. He has been spotted in the area we used to live in but it's on the boarders of 3 counties so he could be in anyone of them! I suspect I know which county and borough council he's in, however, and have the girlfriend's name. But I don't know for sure that he's with her. Shall I put a letter in - where I believe he is and leave it suitably vague?
