Hello All. It's been a while!
Ex and I are both now located at the opposite end of the country. With the removal of the girlfriend (for the second time!) things are easier. Not convinced she's not relocating herself, however, so we'll see how that goes....kids are happy, that's the main thing. Seeing ex on a regular basis and mum and dad aren't arguging in front of them!
New address for both myself and ex given to the CSA - he has still had no contact with them at all. No surprise there, then. Have teen told by the CSA that until he acknowleges at letter at the new address, they'll have to send everything to both addresses (they accept that as I drop the children off at the new address, he's there but if he doesn't acknowledge, it's not 'official' in their eyes!!! What a waste of money from a postage point of view but anyway...)
The case is now sitting with 'Crown Hill debt enforcement complex cases team' (what a mouthful!) as it has been returned from the 'inspectors'. All very mysterious (aka 'confidential'). Inspectors did not speak to the ex but did, however, 'find alot out'.
I now have a named case worker (who admits she could be re-located within the CSA at any point!) but she clearly has a grip on things and is thinking with her head on. She has admitted this will be a long term thing and that she wants to play it the 'right way'. It is too long to recount here but it made sense when I spoke to her!
The interesting bit is that the answer to my question 'why are you not prosecuting the company for not paying a Detachment (or is it attachment?!) of Earnings Order. Her response was....'I can't tell you why but that avenue is no longer open to us...' followed by very, very pregnant pause, loud sigh. I would be interested in anyone's response to this - given the non - payment of Corporation Tax and failure to file accounts with Companies House since 05/06, I am assuming that either the HMRC or Companies House have claimed first dibs on prosecuting hiim?
Ex made a few thousand on house sale - as it was also my house I have in my possession a completion statement so caseworker said she'd been interested in seeing that. It shows that he had money available to pay the debt off (now c. £4k) at the moment the house completed and gives her something to question him on should she ever get to speak to him (...there goes the flying pigs, en masse....).
New (to him) car purchased. Registration given to CSA. He bought a boat, for good measure. A small one, but a bloody boat none the less! Have told CSA where it's moored - I am waiting for a suitably 'good' moment between us to ask it's name!!!
His new company has been sent an initial enquiry form, as has the ex. She (the caseworker) is awaiting a response....she admitted she's not expecting a response! Noted that new company is still not registered with Companies House although if they're prosecuting him, that's perhaps not surprising? Any thoughts?
Now, the bit I don't get really is how his income is now being assessed. I have told them that I am pretty sure he's not working at the moment and that I'm also pretty sure he's not signing on. New company may or may not be paying him a wage (awaiting response on that, see above, no breath holding, please!. As old company is subject to very confidential processes, case worker says his old assessment no longer stands. But also said that as he hasn't contacted them to tell them anything about his new circumstances, they actually haven't changed the assessment but could put in an interim assessment but she doesn't want to do this. Does this make sense to anyone? I think she was saying that when it eventually gets to court and he turns up with his details which show he isn't working at the moment, (which they 'unofficially' know - ie. old company gone by mysterious, confidential means..., I have agreed that with them but he hasn't mentioned it to them...anyone following this?!), judge will dismiss case outright as assessment is all wrong which means debt is all wrong....and I think she was saying they prefer to go to court with it looking like dodgy NRP not paying rather than dodgy CSA hounding poor NRP who hasn't got a job (I know, I know, plenty of people here can prove how awful they are... but we can at least admire her logic?!!)
Anyway, that's where we're at. Hope everyone is well and not too stressed with the CSA, whichever side of the fence you happen to sit on.0 -

My lovely caseworker phoned this morning, just at the point I was thinking I should probably be calling her for an update.
No joy with the 'new company' although an 'inspector' has spoken to someone there. As I understand it, new company is ex and his friend so they at least know the CSA are after them. I noted yesterday that the ex has taken the new company address down from his website. Very clever! 'Inspectors' are now being sent out to that address as well. We'll see what that brings.
She wanted me to confirm a 'confident address' for the ex. He has returned post 'not at this address' at his new home address. So we went through how I knew it was confident (ie. I drop the children there on a regular basis) and she said she will check with the Land Registry that he owns it (he does). So from now on, they will correspond at one address only. She has called him many times but he doesn't answer - although admits that the number comes up as 'unknown' so laughed and told her that's why he won't answer. She says they have an 'office mobile' so she'll try calling him with that to see if it makes a difference.
As he has not been in contact, she is taking the decision to refuse to give him the benefit of the doubt with an interim assessment. Essentially, his current assessment is for more than what the interim assessment would be so she says it's to his advantage to now contact them and get it lowered if he isn't working/is earning less. She also said that as this thing progresses, I need to realise that if he isn't working (which I'm 99% sure he isn't at the moment), he will be able to challenge the assessment and he will be able to get it back dated to today.
With this refusal to change the assessment, she said she is (somehow) satisfying their procedures so will now be able to move forward with legal enforcement. I made the point that we have another 17 years of this so just how many times would we get to this point - and she agreed, it probably won't be the first. Ho hum. I did wonder if they would hold off on the basis that they'll be doing it again and again but seems not.
So, no further forward really. But at least it feels like something is being done.
Oh and I noticed on Companies House website that one of the company's my ex set up with the girlfriend is being wound up on a compulsory basis by Companies House (gone to 'First Gazette'). I have no idea if this has any bearing on anythign at all really, but it's an interesting point to note.0 -

Well I've been at it for several years and he has tried every stupid trick to be found on anti-child-support websites, but he has in general been made to pay, eventually.
He's on PAYE which makes it so so much easier, I realise.
Even so, we have had enforcement involved and several DEOs set up. Things like knowing the car registration help when enforcement get involved...Please do not confuse me with other gratefulsforhelp. x0 -
CSA phoned. They are going down the road now of getting a Liability Order so we'll see what that brings. Ex is now working for a local agency, as of this week, and has indicated he will start paying as soon as he is paid. Heard that one before! It does seem that there is some movement now after so long with nothing at all so fingers crossed the threat of court action will get his head out of the sand and get them to contact him but somehow, I suspect that won't happen! Flying pig anyone?!0

Quick update. Received bank statement today and lo and behold, since the ex started working 7 weeks ago, he has made 2 small payments into my bank account. I have no idea how reflective these payments might be of his current salary (they are very small - less than my meagre budget for the weekly shop), but I guess something is better than nothing. Phoned CSA to tell them payments had been made to get it noted on the system. Woman I spoke with laughed and said 'ah yes, that old chestnut, you tell them there's a liablity order on the way so they make a couple of payments in the hope a judge will be sympathetic....'.
Notice that a Liability Order was being sought sent to ex at beginning of November. This has not (predictably) prompted him into contacting them, nor has he asked for the Order hearing to be heard closer to home. Was told to expect an update no earlier than the end of January.0 -
