Vodafone (UK) to the court on Mis-selling

Hi

I am in process of compiling a court case against vodafone, just wondering if any one can share their experience.

I moved to Vodafone on 07 May 2010 few days after recieving a sales call to my other vodafone mobile offering me unlocked I-phone on £35 per month, 18 months contract.

After recieving the phone I was made aware that it cannot be unlocked.

I moved from £10 per month on 3G Hutchison to £35 per month on Vodafone for nothing.

On top of that after receiving the phone I was still getting sales call offering the same contract with unlocked I phone and this time I took the name and even phone number of the sales person and forwarded it to complaints department in Vodafone

But complaints department clearly failed to acknowledge the complaint saying there was no such call made and claimed to trace a sales call which had nothing to do with the actual sales.

If somone either have any experience to share or can offer some advice on their dealing with vodafone please do not hesitate.

I have decided not to approach OTELO as I have compelling evidance against Vodafone to take them straight to the court.

If you wish to chip in your issues in my case, feel free to share.

    Are you sure it was Vodafone calling not some third party claiming they were vodafone. There are many cases where the caller claimes they are from Vodafone (or o2/orange/tmobile etc) and in reality they are just a 3rd party dealer trying to get the commision from a new sale.

    If you are trying to sue Vodafone because they cannot unlock your contract iphone which you were made aware of, that is normal practice whilst you are still in contract.

    As soon as your contract has ended, Vodafone will unlock your iphone.

    What would you expect a Court to do, order Vodafone to unlock your iphone ?

    You will be throwing money at a case you cannot win.

    Without a recording of the phone call and proof of where it originated, Vodafones legal team will have it thrown out of court in seconds.

    I can't see proof in the OP's description that the original sales call was actually made by Vodafone

    It may have been an independent dealer.

    In court, you need hard evidence. If you are absolutely clear what you are going to sue for, can prove it with hard recorded or written evidence of being mislead, then you may, just may have a chance.

    If you don't have that -and your post doesn't lay this out, so forgive me if you do - then your word against a multi-million/billion corporate with its lawyers?

    Certainly there are lots of posts about misselling on here, but as my sparring partner would no doubt say, they very rarely put anything in writing so it makes it difficult to prove.

    Firstly, OTELO would probabily save your time in this, as you dont have a court case... What exactly do you think you'll be able to achieve?

    Plus, you might want to find some evidence rather than evidance as courts aren't too keen on the latter :D
