Hi Guys,
An elderly friends live in an upstairs flat which they own but the ground floor flat has just been bought by a man who has let it out. The new tenants decided they wanted to install Sky and this was done when our friends were out of the country. The Sky installer was insructed by these tenants to install two points, one at the front and the other at the back of the property and to throw the cable over the roof of our friends flat and then nail the black cable to the stone external wall of their home. It looks an absolute eye sore and the cable also hasn't been secured and in windy conditions it vibrates against their roof. The Landlord has told our friends that because the building is leasehold they can't stop his tenants doing this. Surely this is wrong as our friends maintain the roof and facial boards. Can our friends demand that this cable is removed and re-routed through the downstairs flat it they want more than one Sky socket.

If it runs near the windows, just reach out with a pair of wire cutters, cut it at each side and let it fall away the next time the wind blows........0

That's what most people would do but if the landlord is right they'll end up in court for something these low lives have done with no consideration for anyone but themselves.
The legal answer would be appreaciated.

Is the Landlord also the Freeholder ?

The lease is held by a limited company and it is about to be transferred from the developer to the 4 lease holders (Its a block of 4 flats) of each flat. The landlord is no different to anyone else. Yes we did contact the tenant and it ended up with the Police visiting him 3 times as he attacked some of the neighbours when he was high on drink and drugs, he's not particularly nice.

And you're worried about a Sky cable? Doesn't make sense to me.0 -
These people love their home that they've spent some of their life savings on and then to see someone come along and tresspass on their property which no respect to anyone but themselves. Surely they have a legal right to remove this cable. Otherwise the society we all respect will go down the pan.

Why on earth would society go down the pan just because one idiot installs a Sky cable which doesn't look too hot? :rotfl: You have already been advised to read the long lease - why do your friends maintain the roof, usually this is a communal responsibility? Chances are at present only the freeholder has the right to grant consent to install a Sky cable; when the freehold is transferred to the leaseholders they will be able to enforce any covenants in the long lease. However doesn't sound like the are going to be three votes against due the the ASBO landlord.Declutterbug-in-progress.⭐️⭐️⭐️ ⭐️⭐️0 -

A drawing pin through the middle is much more unobtrusive, and once removed with cause intermittent faults while it rains. ...:mad:A kind word lasts a minute, a skelped erse is sair for a day.0 -
